Torrey Bk#: 3668 <br /> 23 Treasure Lane Page #: 244 <br /> (Map 96 Parcel 10 1) <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 19, 2018 by Owners, Paul F. and Patricia Tomey <br /> requesting Variance relief from frontage and lot size under §174-31 of the Zoning Bylaws <br /> to allow for construction of a single-family dwelling on property located in an R-3 Zoning <br /> District, 23 Treasure Lane, Map 96 Parcel 101, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 27, 2018 and August 3, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 22, 2018 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Board Members, Ron Bonvie, Scott <br /> Goldstein, and Norman J. Gould. <br /> Attorney, Kevin Kirrane represented the Torney's requesting to raze an existing <br /> building and replace it with a new code compliant building. The homeowners were also <br /> present. The lot in question has 10,000 sq. ft. and 100 ft. of frontage on Treasure Lane. The <br /> two bedroom existing structure has approximately 768 sq. ft. The property is developed <br /> with two bedrooms, and was built in the early 1960's with a shed on site, and an attached <br /> deck. The applicants are proposing to remove and replace this particular structure with a <br /> new dwelling which is approximately 500 sq. ft. larger than the current dwelling. There <br /> will be some finished space in the basement and will be converting the two bedroom <br /> dwelling to a four bedroom dwelling. <br /> Mr. Kirrane said this proposal request is similar to Amy Brown Road, and Hamblin <br /> Road consisting of a new construction of a building that conforms in all respects to current <br /> Zoning. It meets all the appropriate setbacks and both side and rear yard. The front yard is <br /> the average noted on the plan, with a letter attached from Down Cape Engineering to <br /> demonstrate how they calculated the front yard setback based upon the average of two <br /> adjacent buildings. The requested relief relates to the lot size and the frontage. <br /> 1 <br />
