Gorbaty requesting a <br /> Written Finding under §174-17 of the Zoning Bylaws to allow for construction of a master <br /> bathroom and great room on property located in an R-3 Zoning District, at 45 Nehoiden <br /> Road, Map 125 Parcel 116, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on July 27, 2018 and August 3, 2018 a copy <br /> of which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 22, 2018 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Board Members, Ron Bonvie, Scott <br /> Goldstein, Norman J. Gould, and Associate Member, Brad Pittsley. Also present was <br /> Building Commissioner, Michael Mendoza. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Geoff Bright, of Synergy Home Improvements represented the applicant. He <br /> said that the plot plan depicts the addition for the living space behind the house at present <br /> is not conforming to the existing setbacks and is requesting a Written Finding. <br /> Mr. Furbush asked the applicant if the existing setback was 31.3 ft. from Wamesit, <br /> and from Nehoiden Road, is 21.7 ft. He said that the hardship exists because it's a corner <br /> lot. <br /> Mr. Bright said that the project consists of an enlargement of the master bedroom <br /> and a bath room. The front room is existing. The deck is becoming the great room. The <br /> deck is 20 ft., and the addition is 18 ft. <br /> Mr. Goldstein read the Board of Health and Conservation comments into the record. <br /> Mr. Gould read the Inspection Department comments into the record. <br /> 1 <br />
