Mr. Jennings efforts to obtain counsel when he was notified in late July were delayed. <br /> Mark Jennings did n t receive the certified letter that was railed on,September 11, 20121, for almost <br /> a month later, and at that time retained Attorney Cavanaugh. <br /> Joe Cavanaugh stated that there is a financial hardship on Mr.-arid Mrs. Jennings and requests the <br /> Board to reconsider the fires. Mr. Jennings is semi-retired, and Mrs. Jennings is also retired-and <br /> disabled. Mr. Jennings teaches at a college and is earring a degree towards his Master's Degree. <br /> Their combined income is not very much. <br /> Lucy Barton commented that the contracts and the inspection have been completed and in <br /> compliance. When it comes to a hardship, the Board is very understanding and generous. <br /> Luer Burton made a motion that the Board of Health waive the fines issued against 24 Spoondrift <br /> Way. Kalliope Egloff seconded the motion. The motion was unanimously approved. <br /> Glen Harrington stated that the discussion with Town Counsel was the informationprovided by Mr. <br /> Jennings through Attorney Cavanaugh including the floor plans. Town Counsel was impressed that <br /> the Je�nning still have the original documents. Attorney Costello omr ented�that the folding partition <br /> in the room created two rooms and the definition of single farhily homes is a presumption of having. 3 <br /> bedrooms. At this point Attorney Costello feel .it is best to leave it as three bedrooms. <br /> Burton Kaplan has suggested that Town Counsel provide a written opinion of his recommendations <br /> for 24 Spoondrift Way. <br /> In regards to the July 2 , 2012, motion made by the Board.of Health to enact a Deed Restriction on <br /> 24 Spoondrift Way to restrict the property to a two-bi9droom dwelling, Calliope Egloff made a motion <br /> to rescind that portion-of the notion. Lucy Burton seconded the motion. The motion was unanimously <br /> approved. <br /> ADDITIONAL TOPICS <br /> None. <br /> DISCUSSION <br /> 1. Indoor T nnin . <br /> Burton Kaplan commented that indoor tanning was discussed at the last meeting with further <br /> protection of the young adults who have a desire to experience tanning. Kalliope Egloff suggested <br /> that it would be best on a regional basis rather than town by town. Glen Harrington emailed the <br /> surrounding towns, two of which were not interested. The Town of Bourne will present it to their <br /> Board for comment. <br /> Lucy Barton commented she would like to continue some discussion on indoor tanning. It could have <br /> an impact especially with teenagers. <br /> Glen Harrington will correspond with the health agents before the nes t Health Agents Coalition <br /> Meeting and receive their input on indoor tanning. <br /> Burton Kaplan suggested further discussion of indoor tanning at the net Board of Health meeting. <br /> . Medical Marijuana. <br /> Glen Harrington stated that he provided all the information he received to the Board. He also <br /> forwarded the information to the Planning Board and to the Town Manager since it was a topic of <br /> discussion on their agenda. <br /> 3 <br />
