No motion to continue was needed due to the matter being for Information purposes only. <br /> 7:25—Public Hearing--Draft Tobacco Regulation <br /> Mr. Harrington stated that the first public hearing was held on June 7, 2018 where the Board took <br /> comments from retailers, attorneys and regulators, The regulation was amended on June 28, 2018 to <br /> include the Board's comments and the public comments. Major revisions after the public comment period <br /> were the removal of the tobacco cessation signage requirement; removal of the automatic revocation of <br /> a tobacco permit after three sales to minors in a year;a revision of the distance requirement between a - <br /> new tobacco permit and a school (building vs. property);the addition of a requirement for smoking bars <br /> to be situated In a free standing building;and a revision to the section on self-serve displays to allow them <br /> in adult-only retail stores, <br /> Mr. Harrington summarized that, on July 12, 2018, the Board reviewed the draft regulation and made <br /> minor grammatical changes with a few questions on definitions, The requested changes were to add—ed <br /> to the word "flavor" to make it grammatically correct; a comma was added between the footnote <br /> references; and on page 8, In Section E(1), the word Town was added to make Town of Mashpee. In <br /> Section D(2)—Required Signage,the Board had asked if there was a minimum font size to the lettering on <br /> the required sign. Mr. Harrington answered that DPH is the one who makes the sign and provides it to <br /> the Board of Health and retailers,so they have control over the font size. The Board had asked about the <br /> definition of "Indoor establishments" in Section 1)(2)(b), and Mr. Harrington explained that the word <br /> "workplace"by definition Is a better fit, as It includes all indoor areas of employee-occupied space. There <br /> was a question on Section E(8)(a) as to whether the number of tobacco permits in Town included <br /> Walgreens and Stop&Shop, given they would essentially lose their tobacco permits with the adoption of <br /> 1 <br />
