Town of Mashpee 16 Great Neck Road North Mashpee, Massachusetts 02649 BOARD OF HEALTH -- PUBLIC SESSION Mashpee Public Library— Small Event Room Minutes of the Meeting of October 25, 2018 Board Members Present, Member Absent: Also Present: Brian Baumgaertel,Chair None Glen Harrington, Health Agent Laurel Almquist,Co-Chair Mallory Langler,Clerk Chair Brian Baumgaertel called the meeting to order at 7:00 PM, APPOINTMENTS 7:00--AFCEC,Joint Base Cape Cod=Annual Update Glen Harrington advised members that the JBCC presentation had been postponed at the request of the presenters. No motion to continue was needed due to the matter being for Information purposes only. 7:25—Public Hearing--Draft Tobacco Regulation Mr. Harrington stated that the first public hearing was held on June 7, 2018 where the Board took comments from retailers, attorneys and regulators, The regulation was amended on June 28, 2018 to include the Board's comments and the public comments. Major revisions after the public comment period were the removal of the tobacco cessation signage requirement; removal of the automatic revocation of a tobacco permit after three sales to minors in a year;a revision of the distance requirement between a - new tobacco permit and a school (building vs. property);the addition of a requirement for smoking bars to be situated In a free standing building;and a revision to the section on self-serve displays to allow them in adult-only retail stores, Mr. Harrington summarized that, on July 12, 2018, the Board reviewed the draft regulation and made minor grammatical changes with a few questions on definitions, The requested changes were to add—ed to the word "flavor" to make it grammatically correct; a comma was added between the footnote references; and on page 8, In Section E(1), the word Town was added to make Town of Mashpee. In Section D(2)—Required Signage,the Board had asked if there was a minimum font size to the lettering on the required sign. Mr. Harrington answered that DPH is the one who makes the sign and provides it to the Board of Health and retailers,so they have control over the font size. The Board had asked about the definition of "Indoor establishments" in Section 1)(2)(b), and Mr. Harrington explained that the word "workplace"by definition Is a better fit, as It includes all indoor areas of employee-occupied space. There was a question on Section E(8)(a) as to whether the number of tobacco permits in Town included Walgreens and Stop&Shop, given they would essentially lose their tobacco permits with the adoption of 1
