state law would invalidate it, He stated that the Attorney General has taken action with regard to online <br /> sales to minors, and that the•FDA is working with six major manufacturers to address the Issue, which <br /> speaks to the emergent nature of this, He reminded the Board that it is illegal to ship cigarettes into <br /> Massachusetts,but It is legal to ship vaping products, <br /> Chairman Baumgaertel Informed the audience that the Board would be looking at the revised regulation <br /> at the November 8, 2018 meeting, and encouraged public attendance but reminded retailers that it was <br /> not a hearing so there may not be a public comment period, <br /> NEW BUSINESS <br /> 1. Approve Board of Health Meeting Minutes, Minutes of the September 27, 2018 Executive <br /> Session and the October 11,2018 Public Session were reviewed without changes, Mr.Harrington <br /> reminded the Board that the Executive Session minutes cannot be approved until litigation is <br /> completed, <br /> There being no questions or revisions, Mallory Langler moved to approve the minutes of the <br /> October 11,2018 Public Session, Motion seconded by Brian Baumgaertel. VOTE: Unanimous(3- <br /> 0). <br /> 2, Sign Expense Warrants, Board members signed the expense warrant. <br /> 3. Request for Tobacco Sales Permit—9 Shellback Way, Colbea Enterprises U.C. Mr. Harrington <br /> commented that a request for a 2018 Tobacco Sales Permit had been submitted to the Board of <br /> Health, He stated that he believes the property has not been sold to the applicant;therefore, per <br /> the Tobacco Sales Regulation,the Board cannot issued a permit, Mr.Harrington told the applicant <br /> that they could submit an application but it had to include evidence of a Purchase & Sales <br /> Agreement. Since no evidence of intent to purchase was attached to the application, he <br /> recommended that the Board continue the matter until the applicant can show ownership_. There <br /> was no one present to represent the applicant. <br /> Mallory Langler moved to continue the request for Tobacco Sales Permit at 9 Shellback Way until <br /> a later date. Motion seconded by Brian Baumgaertel, VOTE: Unanimous(3-0). <br /> 4, Request for One Time Temporary Food Permit Fee—Northern Soul. Mr. Harrington commented <br /> that a request for a one-time fee of$100.00 to cover multiple events(more than two)for the rest <br /> of the year had been made by Northern Soul. The request was consistent with other applications <br /> from temporary food vendors and,therefore, Mr.Harrington recommended approval of the one- <br /> time $100,00 fee for the remainder of the year for multiple food events. There was no one <br /> present to represent the applicant. <br /> Ms. Almquist asked if Mr. Harrington had any additional information on the applicant, and Mr, <br /> Harrington stated that Northern Soul Is relatively new and this was their first time applying with <br /> Mashpee. He further stated that the applicant is building an establishment In Hyannis and <br /> currently has a temporary food permit from that town, because they don't yet have a full service <br /> commissary to workout of, Ms.Langler asked if the applicant would be prepping and storing food <br /> In the field and Mr. Harrington answered in the affirmative, stating that they transport <br /> refrigeration units to/from the location. <br /> 4 <br />
