There was a discussion regarding if the contractor should be responsible for what the rules are and the <br />Commissioners asked the Agent to look into levying fines against the contractor. The Chair stated if an <br />engineer tells us the best thing to do is to file an overall plan which includes leaving the piles in place or driving <br />them further than it is probably what we should allow for. If the Commission decides we should not go there, we <br />should see a plan for removal of piles. He doesn’t want to see any further damage done to the environment. <br /> <br />The Agent referenced Regulation 172-6. He said if the Commission were to move in favor of removing the dock <br />permit, it would have to be advertised as a public hearing. The Agent stated he would get clarity from town <br />counsel on how to proceed. <br /> <br />There seems to be a consensus to revoke the current permit but we need to get more information. The Attorney <br />said his client is agreeable to coming back with a new NOI. The Agent said any formal action needs to be <br />advertised in the newspaper. <br /> <br />The Chair said he would like to go ahead and impose the fines and would like to direct the agent to look into <br />placing enforcement action against the contractor and encourage the homeowner on how he wishes to proceed. <br /> <br /> <br />The Agent reiterated the fines: two times jetting of piles $300 each, violation of cease and desist order twice <br />$300 and lack of Chapter 91 license for 266, $300 = $1500 <br /> <br /> <br />Motion: Mr. Sweet moved to enforce the fines as described, for the total of $1,500 under 172-11. <br />seconded by Mr. Smith. Vote 4-0 <br /> <br />Mr. Gottlieb asked about the regulation and the Agent stated the fines cannot be enforced without a public <br />hearing. <br /> <br />Motion: Mr. Smith moved to initiate the process of having a public hearing for the revocation of the <br />license at 266 Monomoscov, seconded by Mr. Sweet. Vote 4-0 <br /> <br />Discussion: Proposed changes to Regulation 27 <br /> <br />The Agent stated he has been reviewing regulation 27 and has reformatted it and took out some unnecessary <br />wording. He asked if the Commissioners could review it and asked them to let him know if they have any further <br />comments. A public hearing is required to make these changes. <br /> <br />Updates: Assistant Agent <br /> <br />Katelyn Cadoret, Assistant Agent, stated things are going well. An intern has come on board and her duties will <br />be to get a general idea of the job, different habitats of the environment in Mashpee and expose her to different <br />aspects and to different volunteer programs we have. <br /> <br />She said they are doing general prep for the summer. The trees and shrubs planted at Santuit Pond are doing <br />well. She is planning to do an overhaul at the kiosks so they will be more useful.
