<br />83 Clover Lane/82 Nick Trail: unpermitted pruning on a coastal bank. Agent recommends filing of after-the-fact <br />NOI for vista pruning on both properties. <br /> <br />The Agent noted these were two side by side properties. The homeowner owns both properties and the rogasa <br />rose was cut down. He said there is not an opportunity for mitigation here because it will grow back more <br />aggressive and would not recommend replacing it with something else. He recommended the homeowner be <br />assessed $300 in fines for each property and require the homeowner to file two NOIs after the fact for vista <br />pruning on this property. <br /> <br />Paul Hamlin, owner, said it wasn’t his intent and that he only wanted to clean up the bushes but there was a <br />language barrier with his landscaper. He said the bushes all have filled in and he also pulled trash from the area. <br /> <br />Motion: Mr. Sweet moved to issue two $300 fines for a total of $600 and require the homeowner file an <br />NOI for each property for after the fact vista pruning on these properties. <br /> <br />44 Little Neck Lane: Illegal clearing of trees/shrubs on a coastal bank. Agent recommends fines to be issued to <br />homeowner and contractor (Pelican Landscaping). Agent also recommends homeowner to file NOI for mitigation <br />of denuded coastal bank. <br /> <br />The Agent said this is one of the worst violations he has seen. It is the total denuding of a coastal bank of shrubs <br />and trees. Pelican Landscaping was in the act of doing the work when he discovered this situation, they claimed <br />they were only there to remove some of the shrubs and poison ivy and a couple of trees that were in close <br />proximity to the dock and pier. He said there was a total of 11 trees of varying sizes completing gone from the <br />bank and he had the landscapers put in hay bale and silt sod on the bank. He said there were no <br />communications to the department at all. A violation notice was sent and we haven’t heard back yet. He noted <br />the violations on pictures he provided. His recommendation is $900 fine to the homeowner for clearing of <br />vegetation on a coastal bank, clearing of vegetation in bordering vegetation wetland, and violation of chapter 172 <br />Coastal Bank regulations, $300 fine to landscaper and the homeowner will be required to file an Notice of Intent <br />for full restoration and mitigation of the coastal bank including a multi-year maintenance and monitoring protocol <br />professionally prepared plans by a landscape architect or wetland consultant/specialist. Project supervision and <br />monitoring to ensure 100% compliance and success of plantings and immediate stabilization measures to prevent <br />erosion on the bank while this compliance is being achieved. We haven’t heard back within five days and that <br />constitutes and automatic enforcement order. <br /> <br />Motion: Mr. Sweet moved to issue and Enforcement Order with the fines outlined by the Agent. <br /> <br /> <br />ADDITIONAL TOPICS <br />(This space is reserved for topics that the Chairman did not reasonably anticipate would be discussed). <br /> <br />Mr. Charles Dalton, candidate for a Conservation Commissioner, introduced himself and explained why he <br />wished to become a Commissioner.
