<br />Mr. Smith said he understands that he is responsible and he didn’t make sure the application for <br />Chapter 91 was applied for. When he found out, he started the process immediately. He said as <br />far as the cease and desist, he notified the contractor. <br /> <br />Chip Young, AGL, said Mr. Smith contacted him and said there was a cease and desist. An <br />employee of AGL at 3:00 in the afternoon put one pile in the water. He said he told the employee <br />there was a cease and desist order and he did the work anyway. The Agent noted when order of <br />conditions is issued, it requires the owner and the contractor’s signature on a sign off sheet that <br />states they have read and understood the order of conditions. Mr. Smith stated he needs to have <br />someone represent him that know his legal rights and he feels he did everything possible to do <br />what the Agent asked him to do. <br /> <br />The Agent noted the barge had no engine and was pushed by a skiff which was stored on top of <br />the salt marsh along with piles floating in the water banging into the salt marsh. He said it is the <br />owner’s responsibility to provide oversight. The Commissioners agreed to place this issue on the <br />June 28 pre-post agenda in order to have his attorney present. <br /> <br />Motion: Mr. Sweet moved to re-open the 6:18 hearing, seconded by Mr. O’Neill.
