The Chair stated that another option, recommended by Ed Baker, would be t <br /> merge the water District into the Town and eliminate the water District Commissioners, <br /> creating a joint water/Sewer Department-under the Town. Mr- Klenert stated that it would be <br /> impossible to join the Commissions because the water District was elected and the Sewer <br /> Commission was appointed. Mr. Klenert stated that a warrant Article would be needed in order <br /> to abandon both commissions,, organizing an election for a separate water/Sewer Board, along <br /> with action from state-legislation. Mr. Malarkey inquired whether the water district was outside <br /> of the authority of the Town and the Chair responded that it was.. Mr. Malarkey stated that the <br /> Water District must be a willing participant in order to move forward and inquired whether <br /> "Vater District Comnu'ssi ners were willing to join together. Chairman Fudala stated that <br /> Kenneth Marsters, Chair of the Water District, has indicated that he would be in favor of <br /> discussing a joint water/Sewer District, The Chair added that Ron Gan emi has been quoted in <br /> the paper as having doubts and Perry Ellis has been opposed in the.past. <br /> Mr. Lyons'suggested that, from a legal perspective, there were three solutions. First, the Sever <br /> Commission could sit under the Water District. The second option would be if the Town <br /> established a new Sewer/Water District. Finally, two separate districts could be established for <br /> Vater and for Sewer_ Chairman Fudala stated that the Town could not eliminate the Water <br /> District without state legislation and Mr, Malarkey noted that the water District would need to <br /> join with the Town with a request to change the legislation. �h irn n Fudala stated that, <br /> technically, the Town could request a change to legislation against the vll of the water District <br /> but that it would be a political war. Additionally the water District Meeting could submit a <br /> Article requiring that water District Commissioners submit the legislation. 'Mr. Lyons inquired <br /> about the most probable option and the Chair responded that the best option would be for the <br /> Water District to submit legislation. The Chair referenced a memo from William Henchy that <br /> described the process of changing the.water District's legislation to add the development anal <br /> funding of sewers to the water District's charge. The Chair emphasized the benefits o using an <br /> existing organization, with staff'in place, to take over a sewer utility and all Commissioners <br /> agreed that they would not want to duplicate efforts. <br /> Mr. O'Hara inquired about any advantage to eliminating the water District. The Chair stated <br /> that he did not support the idea and emphasized that bringing Sewer into the water District <br /> would eliminate duplication and create an entity with the sole purpose of protecting water. Mr. <br /> O'Hara has spoken to Mr. Marsters and Mr. Gangemi and inquired whether it would make sense <br /> to have elected Sever Commissioners as advisors to the water District Commissioners to create <br /> n easy transition. Mr. Lyons referenced the legal position which stated that a change to the <br /> Chaster would be required, which would then require a change to the structure of the water <br /> District. Chairman Fudala stated that there'would be no benefit to having two separate water <br /> and Sever Districts. Regarding serving in an advisory role, the Chair stag that Sewer <br /> Commissioners were responsible for decision making and implementing a plan. <br /> Mr. Marcelli stated that here would be no benefit to the residents of Mashpee should water and <br /> Sewer.be combined. Mr. Marcelli stated that the only reason to join the two commissions was so <br /> that the District would have the ability to tax without any concern for Proposition 2 1/2. Mr. <br /> Marcelli expressed concern that the cost-of sewers could drive people out of Mashpee. Mr. <br /> Marcelli also expressed concern about Mashpee having -1 o sewer treatment plants for a <br /> population of IS,000 (doubled to 30,000 during the summer). =fir.'Marcelli stated that 8 5% of <br /> the nitrogen coring from a septic system was from urine and reported that urine diverting toilets <br /> 2 <br />
