Case 1:10-cv-11455-MLW Document 11 Filed 08/25/11 Page 3 of 6 <br /> 1. The parties shall conduct mediation of this matter during the period of September <br /> 6, 2011 through December 6, 2011. <br /> 2. On or before December 6,2011,the parties shall submit a'Joint Report to the <br /> Court that will report either that a mediated resolution is not,likely to be reached and the case <br /> should proceed in accordance with the schedule outlined below or that the parties mutually agree <br /> that some additional time is necessary to complete the Mediation process and the parties <br /> therefore seeker:further extension of deadlines in this case. <br /> 3. Unless the parties mutually request additional time for the Mediation process in <br /> accordance with paragraph 2,the case shall:proceed under the following schedule: <br /> A. Defendants shall file an Answer or otherwise respond to the Complaint on <br /> the earlier of thirty(30) days after the termination'of the Mediation process by mutual written <br /> consent of all parties to the Mediation(without a resolution of this action) or January 6,2012. <br /> B. Defendants shall file the index to the administrative record or the record <br /> itself on the same date it files its Answer or other response to the Complaint,as set.forth in <br /> paragraph 3A above. If an index is filed,Plaintiffs shall have access to the full record on this <br /> date. <br /> C. If the Defendants file a Motion to Dismiss or other dispositive motion <br /> rather than an Answer: <br /> l. Plaintiffs' opposition brief shall be due forty-five (45) days after <br /> the Defendants' motion is filed; and <br /> 2. Defendants' reply brief due thirty-six(36) days thereafter. <br /> 3. Plaintiffs shall have the right to cross-move for summary judgment <br /> 1 <br /> in addition to opposing the Defendants' motion, in which event Defendants' opposition papers <br /> 3 <br />
