DRAFT 7-25-11 <br /> WHEREAS,the Selectmen and Commissioners mutually agree that there is a pressing <br /> need to address,residential, commercial and industrial wastewater disposal needs and options for <br /> all properties located within the Town of Mashpee in an effort to protect the environment, sustain <br /> property values and facilitate responsible growth and development within the Town; <br /> WHEREAS, at a joint meeting of the Selectmen and the Commissioners on April 20, <br /> 2011, it was determined by vote of each body that the most logical and effective means for <br /> developing and implementing a public sewer/wastewater disposal system within the Town of <br /> Mashpee would be for the Mashpee Water District, or a successor/reconstituted entity thereof,to <br /> assume legal jurisdiction, control and supervision of the public sewer/wastewater collection and <br /> disposal functions of the Town. <br /> NOW,THEREFORE,the Board of Selectmen and Water District Commissioners hereby <br /> agree as follows: <br /> 1. The Selectmen, on behalf of the Town of Mashpee, and the Commissioners on <br /> behalf of the Mashpee Water District,herby agree to collectively utilize their <br /> resources, officers, employees and agents to devise a plan and to implement the <br /> transfer of public sewer/wastewater treatment and disposal functions from the <br /> Town of Mashpee to the Mashpee Water District, or a legislatively authorized <br /> successor entity thereto. <br /> 2. . The Selectmen,Mashpee Sewer Commissioners and Water District <br /> Commissioners agree to meet periodically with appropriate consultants and/or <br /> counsel to prepare and implement a strategy for said transition of said functions, <br /> duties and responsibilities. <br /> 3. To the extent that special legislation by the Massachusetts General Court will be <br /> required to facilitate and implement this transfer of jurisdiction, duties and <br /> responsibilities,both the Town and the Mashpee Water District shall support such <br /> special legislation. <br /> 4. The parities hereto expressly agree that it is in the interest of the citizens,property <br /> owners and rate payers of the Town of Mashpee,to establish this initiative as a <br /> priority venture of the Selectmen and Commissioners; accordingly, each body <br /> shall dedicate appropriate resources and effort to facilitate and achieve the <br /> 1) <br />
