Haney <br /> o Great Neck Road South(Map 99 Parcel 40-0 <br /> Mashpeea MA 02649 <br /> FINDING- o 1 8-5 5 <br /> Attorney Wali said that this is an opportunity to control this use and give the <br /> neighbors some relief and allow his client to have a reasonable use of the helicopter. He <br /> does not know what the Court would do of an appeal of a cease and desist but if his client <br /> tale n appeal and prevails there will be no conditions. <br /> The Board discussed scenarios regarding conditions but did not know how the <br /> Town could enforce those conditions <br /> Attorney Wall stated that these conditions are material to the use being substantially <br /> similar to those allowed, and substantially dissimilar to those permitted, any minute <br /> deviation or any condition will cause irreparable harm. If this client did not comply with <br /> those, Town Counsel could submit an injunction. <br /> There were no final comments from the Board or audience. <br /> In view of the foregoing, the Board determined did not meet the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday,November 28,2018,the Zoning Board of Appeals voted unanimously to deny <br /> the Petitioner,William R. Haney's,request for a Written Finding under Section 174-24(K) <br /> of the Zoning Bylaws to allow for a helipad on property located in an -3 Zoning District <br /> (Map 99, Marcel 40-0), Mashpee, ISA (Owner of record: Mary E. occhi). <br /> 4 <br />
