7, The Property is located within a residential (R-3) Zoning District. <br /> 8. Mrs, 2occhi's husband, William R. Haney ("Haney"), has a license to fly <br /> helicopters and owns and flies a Robinson R44 helicopter. <br /> 9. In 2007, Haney sought a Federal Aviation Administration (FAA) determination <br /> of airspace suitability for a private helicopter landing area at the Property. <br /> 10. The FAA responded by recognizing the Property as a licensed private use <br /> heliport. <br /> 11. Haney also obtained an airspace review approval from the Massachusetts <br /> Department of Transportation, Aeronautics Division (Aeronautics Division) <br /> and thereby registered the Property as a Private Restricted Landing Area and <br /> the area was designated as Landing Area Number 15 in Mashpee. <br /> 12. Haney has continuously renewed his designation since 20Q7 and his helipad <br /> continues to be "sanding Area Number 15 in Mashpee," <br /> 13. After receiving this designation, Laney cleared and leveled a portion of the <br /> Property and constructed a gravel pad for purposes of landing his helicopter. <br /> 14. Haney also constructed a storage shed on the site and installed a pole with a <br /> wind sock attached, <br /> 15. The helipad was inspected by the Building Commissioner at the time it was <br /> constructed. <br /> 3 <br />
