R, Haney, requesting a <br /> Written Finding under Section 174_24(x) of the Zoning Bylaws to allow for a helipad on <br /> property located in an }3 Zoning District(Map 99, Parcel 40-0), Mashpee, SIA (Owner <br /> of record: Mary E.Zocchi . <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on October 19, 2018 and October 26,2018 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A 6, and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 28, 2018 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan D. Fuarbush, Board Members William A. <br /> Blaisdell, Scott Goldstein, Norman J. Gould, and Associate Members, Brad Pittsley and <br /> Sharon Sangeleer were present. Building Commissioner, Michael Mendoza was also <br /> present, <br /> Attorney Brian Mall represented the applicant requesting a.finding for a helipad. <br /> He said that the reason he filed a request for relief is such that if the Board were to grant a <br /> Written Finding, that says this use can continue per the Board's finding thea be would <br /> withdraw the Appeal of the Building Conunissioner.if the Board doesn't grant the finding, <br /> he has to preserve his client's rights and ask for a decision on the first petition.He said that <br /> he views Section 174-24 K zoning 'I's intended to create harmonious uses of land so that <br /> people can exist in the community peacefully and without nuisance. A Town is divided <br /> into various districts such as residential,commercial,and industrial+ within those districts <br /> some uses are al l o wed as of ri gbt, some are prohibited, and some are allowed by special <br /> permit with an allowed condition+ He said that Mashpee's bylaw use table is what he <br /> submittcd is prohibited. <br /> 1 <br />
