11.Although currently vacant, the Island was used by previous owners as a camp for <br /> hunting and fishing. Remnants of the foundation of a cottage are still present on <br /> the Island. <br /> 12.Before the Island was acquired by the Gooseberry Island Trust, it was owned for <br /> more than 50 years by the Nelson family. <br /> 13.The Nelson family accessed the island by parking at the end of Punkhorn Point <br /> Road and rowing a boat across the narrow channel throughout their years of <br /> ownership. <br /> 14.The Island and the land along the shore are situated within an R-3 Zoning District. <br /> 15.The Plaintiffs seek to develop a single-family dwelling on the Island. <br /> 16.On November 9, 2018, the Plaintiffs filed an application for variances with the <br /> Zoning Board of Appeals seeking relief from the following provisions of the <br /> Zoning Bylaw: <br /> a. Section 174-12 —which requires buildings to be on lots which front upon a <br /> street; <br /> 4 <br />
