3 <br /> Board of Selectmen <br /> Minutes <br /> December 17, 2018 <br /> Public Hearin : 2019 Annual Liquor and Entertainment License Renewals: (continued) <br /> With regards to Finally Dino's, the contractor has not completed the requirements to secure a <br /> building permit for work associated to a vehicle that drove into the building earlier this fall. The <br /> Building Inspector requires a plan for the building permit to repair the damage. <br /> It was noted the subject establishment is on probation having had two critical violations in the past <br /> which have been abated. This matter is deemed a third critical violation. The Board of Selectmen <br /> acting as the Licensing Authority for the Town of Mashpee has the ability to hold a hearing on the <br /> violation, and to consider a three-day suspension. <br /> Constantino Mitrokostas was in attendance to review this matter with the Board of Selectmen in <br /> hopes to move the licensing renewal forward. For the record Mr. Mitrokostas indicated he is not the <br /> owner of the subject establishment. The vehicular damage involves the exterior of the Finally <br /> Dino's portion of the building where two windows and a non-supporting wall are slated for <br /> replacement. Although the accident occurred in October, the windows needed to be ordered. The <br /> contractor installed the windows last week and received a permit for the work. Mr. Mitrokostas <br /> stated there is no safety factor associated to the incident and the landlord of the building is currently <br /> working with the insurance agency. <br /> It was agreed there is no issue with the Board of Selectmen granting the renewal of the license. <br /> However, a plan must be submitted to the Building Inspector before a new license is issued on <br /> January 1, 2019, <br /> The Board of Selectmen reviewed the list of 2019 Annual Liquor License Renewals as outlined in a <br /> memorandum dated December 13, 2018 from Stephanie Coleman, Administrative Secretary. Action <br /> was taken per category as listed by class of license. <br /> Package Store—All Alcohol: <br /> Andy's Market <br /> The Barn <br /> Best Buy Beverages, Inc. <br /> Liberty Liquors <br /> South Cape Wine & Spirits <br /> It was disclosed Paradigm, Inc. d/b/a The Barn has a violation notice issued by the Alcoholic <br /> Beverage Control Commission during 2018 for the sale or delivery of an alcoholic beverage to an <br /> intoxicated person which resulted in a suspension of license. There was no further comment. <br /> Motion made by Selectman Gottlieb to close the Public Hearing. <br /> Motion seconded by Selectman O'Hara. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Sherman, yes Selectman Cahalane, yes Selectman Gottlieb,yes <br /> Selectman O'Hara,yes Selectman Cotton,yes Opposed, none <br />
