i <br /> • <br /> SUBJECT: Minutes of the meeting of the Mashpee Americans With Disabilities Act <br /> Committee, September 9,, 2004 <br /> The Mashpee Americans with Disabilities Act Committee C met Thursday, <br /> September 9, 2004 at Mashpee Town Mall Meeting Room#2. <br /> Members in attendance: <br /> William Dndon <br /> Marilyn Farren <br /> Patricia Parolski <br /> Beverly Wooldridge <br /> Robert Wooldridge <br /> { <br /> The minutes of the August 3, 2004 meeting were reviewed. The mission statement proposed in <br /> the draft minutes was amended by deleting last sentence. The minutes were otherwise accepted <br /> as drafted. . <br /> Russ Wheeler hes departed and Richard Stevens,the new building inspector, has begun work. . <br /> The committee approved naming Richard to Russ'seat. Madlyn offered to submit his name to <br /> Selectmen for appointment. He should be at next meeting. <br /> The committee discussed hog the Ilashpee web site could be used to keep the community <br /> apprised of ADA issues to include providing links to other sites. Providing means for citizens to <br /> contact the committee are also being considered. <br /> l ladl n provided copies of he South cape civic Association (BCCA) response to our letter <br /> concerning street signs in the community. We agreed the measures taken and planned are <br /> positive measures and consider the issue closed pending any further complaint from Mr. <br /> Papagni. Marilyn said he has not contacted her singe the signs began going up. The Building <br /> Inspector will drive through and check for adequacy. If all appears satisfactory,,we will be <br /> sending letter to BeeA thanking therm for their cooperation and quick action. (Letter was mailed <br /> on or about Oct. , <br /> Copies of 12 ADA-related documents Bob obtained from dept. of,Justice were distributed to <br /> those present. Marilyn agreed to provide copies to Jinn Marr and Richard Stevens. Marilyn <br /> provided copies of an ADA-related document discussing to the ACOA and small towns. <br /> Bob also distributed a memo pertaining to access in Mashpee Commons to the members. This <br /> was to response to Fuss'offer at the previous meeting to loots into any specific examples of <br /> access problems. Marilyn agreed to provide a copy to.the Building Inspector. <br /> Bob brought up an issue pending before Conservation Commission pertaining to Mr. Fred <br /> Blthe's request to put a fence across the path providing access to Popponessett Bprt. In this <br /> case, it is the wheelchair and mobility-impaired who would be blocked fror 'reaching the public <br /> area of the beach and Spit. The able-bodied can reach area by stairs at the end of Wading Place <br /> Road. This issue has been pending for quite some time and has most of neighborhood up in <br /> arms. Nancy a ffyn has a lawsuit pending regarding deeded access. Previously, Conservation <br /> has refused to acknowledge the access issue, preferring to treat it strictly as a conservation <br /> matter. The last time this was discussed by Conservation Bob cited a requirement of the ADA that <br /> town boards make reasonable modification to policies, regulations, procedures, etc.,to prevent <br /> discrimination against disabled. Bob pointed out actions that appear to be neutral often have <br /> adverse imp'ac't on disabled. This appeared to resonate with Mr. Fitzsimmons(chairman). The <br />
