Page Board of Selectmen Minutes February 13, 1995 NEW BUSINESS; Appointment of Associate and Full-Member to the Conservation Commission: Communication was received from the Conservation-Commission dated February 3, 1995 regarding membership. Conmrnission member, Fain Averett has requested to step down to Associate member. The Conservation Commission voted to honor the above request. Robert Lopez has been recommended by the Commission to f�fll the vacancy. Motion made by Selectman Costa to approve the request of Paul Averett to step down to Associate Member of the Conservation Commission. Motion seconded by Selectman Dinizio,, VOTE: Unanimous. -o. Motion made by Selectman Costa to appoint Robert Lopez as a Regular Member of the Conservation Commission. Motion seconded by Selectman Dinizio. VOTE: unanimous. -o. Mr. Lopez was present to meet the Board of Selectmen. Mr. Lopez indicated that he has attended Conservation Commission meetings for the past eight months. He is interested in preserving the wetlands and woodlands of Mashpee. Discussion relative to Legal Opinion on Finance Committee Membership: Communication was received from Town Counsel dated February 2, 1995 relative to Finance Committee membership. The Town bylaw, Section 5.8 states that a member of the Finance Committee cannot serve in any other appointed or elected Town office. With reference to persons serving on a School Council and persons working s clerical personnel in the Assessors Office,Attorney Marder indicated haat the bylaw precludes any appointed or elected member of any board,, commission,conunittee or council and any Town employee from serving on the Finance Committee. Unless Town Meetincy clafifies the meaning in a vote to amend Section 5.8, Finance Committee members who are both members of the School Council or working in the Assessor's Office must resign either from the Finance Committee or from the other'T'own office they hold.
