Article . <br /> To see if the Town will vote to authorize the Board of Selectmen to exercise the <br /> option held by the Town as set forth in paragraph 3 of the agreement entitled <br /> "South Cape Beach Development Agreement" between the Town, acting through <br /> its Board of Selectmen, and the Commonwealth of Massachusetts acting by and <br /> through its Department of Environmental Management ("DEM")., dated <br /> December 27, 1994, to acquire certain lands of the Commonwealth and in <br /> consideration therefore to convey to the Commonwealth certain lands of the <br /> Town, as such exchange is further described in Chapter 287 of the Acts of 1982; <br /> to authorize such acquisition and conveyance on such terms and conditions as the <br /> Board of Selectmen may determine, which may include restrictions on the future <br /> use of said lands, the land to be acquired by the Town being described in <br /> paragraph 15 of the agreement entitled "Amended Agreement" between the Town <br /> and DEM dated July 15, 1981, and consisting of approximately 30 acres as shown <br /> on the map attached to said Amended Agreement as Exhibit B and the land to be <br /> conveyed by the Town being described in paragraph 14 of said Amended <br /> Agreement as "all municipally owned lands within the proposed boundaries of the <br /> [South Cape Beach State] Park,"' including the existing town beach and a portion <br /> of Great Oak Road and other parcels within said Park; and to authorize the Board <br /> of Selectmen to petition the General Court of the Commonwealth for such <br /> approvals as may be needed for such exchange pursuant to Article 97 of the <br /> Amendments to the Massachusetts Constitution, or take any other action relating <br /> thereto. <br /> To see if the Town will vote to transfer the care, custody, management and <br /> control of the Town owned Land described in paragraph 14 of the July 15, 1981 <br /> "Amended Agreement" between the Town and the Massachusetts Department of <br /> Environmental Management ("DEM") as "all municipally owned lands within the <br /> proposed boundaries of the [South Cape Beach State] Park," including the existing <br /> town beach and a portion of Great Oak Road and other parcels within said Park, <br /> being the land shown on Assessor's Map , Block , to the Selectmen for <br /> the purpose of conveyance to the Commonwealth of Massachusetts pursuant to the <br /> option held by the Town under -the agreement entitled "South Cape Beach <br /> Development Agreement" between the Town and DEM dated December 27, <br /> 1990, on such terms and conditions as the Board of Selectmen may determine, <br /> which may include restrictions on the future use of said land, or take any other <br /> action relating thereto. <br /> Submitted by the Board of Selectmen <br /> Explanation: <br />
