•3 .` Page 9 .iN Board of Selectmen Minutes March 18, 1996 Qountv Selectmen's & Councilors'Association request for b,- ommittee Appointments: Communication was received from Thomas Newton, Chahmm of the Barnstable County Selectmen's and Councilors'Association dated March 7, 1996 requesting the Town appoint a Selectman, a member of the Finance Committee, and a member of the School Committee to represent a sub-committee to review the disparities in the state's distribution of education funds and lottery revenues. Motion made by Selectman Dinizio to appoint Selectman Nancy Caffyn to serve on the Barnstable County Selectmen's and Councilor's sub-committee. Motion seconded by Selectman Mills. YOTE: Unanimous. 4-0. Selectman Caffyn abstained. The Finance Committee and School Committee will be requested to appoint representative to the above. NEW BUSINESS: Re nest of Pub 99: Attorney Kevin Kirrane and Dana Doe, an owner of the 99 Restaurant wereresent to request the Board authorize the continued construction of p q the restaurant/pub facility located at 8 Ryan's way,Mashpee. It was noted that an abutter to the property filed an appeal of variance in connection with parking space dimension requirements and access way requirements. Attorney Kirrane indicated that his client would like to continue construction of its proposed restaurant, and feels it will either prevail on the appeal or resolve the same with the plaintiff. It was noted that no appeal from the decision has been filed. The party who has appealed the variance has since moved from the abutting condominium unit informed Attorney Kirrane. In the event the appeal is not resolved, the Doe family is prepared to deposit with the town, the sum of$20,000 to be used by the town to restore the property informed Attorney Kirrane.
