•3 <br /> .` Page 9 <br /> .iN <br /> Board of Selectmen <br /> Minutes <br /> March 18, 1996 <br /> Qountv Selectmen's & Councilors'Association request for <br /> b,- ommittee Appointments: <br /> Communication was received from Thomas Newton, Chahmm of the <br /> Barnstable County Selectmen's and Councilors'Association dated <br /> March 7, 1996 requesting the Town appoint a Selectman, a member of <br /> the Finance Committee, and a member of the School Committee to <br /> represent a sub-committee to review the disparities in the state's distribution <br /> of education funds and lottery revenues. <br /> Motion made by Selectman Dinizio to appoint Selectman <br /> Nancy Caffyn to serve on the Barnstable County Selectmen's <br /> and Councilor's sub-committee. <br /> Motion seconded by Selectman Mills. <br /> YOTE: Unanimous. 4-0. <br /> Selectman Caffyn abstained. <br /> The Finance Committee and School Committee will be requested to <br /> appoint representative to the above. <br /> NEW BUSINESS: <br /> Re nest of Pub 99: <br /> Attorney Kevin Kirrane and Dana Doe, an owner of the 99 Restaurant <br /> wereresent to request the Board authorize the continued construction of <br /> p q <br /> the restaurant/pub facility located at 8 Ryan's way,Mashpee. <br /> It was noted that an abutter to the property filed an appeal of variance in <br /> connection with parking space dimension requirements and access way <br /> requirements. <br /> Attorney Kirrane indicated that his client would like to continue construction <br /> of its proposed restaurant, and feels it will either prevail on the appeal or <br /> resolve the same with the plaintiff. <br /> It was noted that no appeal from the decision has been filed. The party <br /> who has appealed the variance has since moved from the abutting <br /> condominium unit informed Attorney Kirrane. <br /> In the event the appeal is not resolved, the Doe family is prepared to <br /> deposit with the town, the sum of$20,000 to be used by the town to <br /> restore the property informed Attorney Kirrane. <br />
