I <br /> } Page 8 <br /> Board of Selectmen <br /> Minutes-revised <br /> March 25, 1996 <br /> ALPOINTMENTS AND BEARINGS: <br /> li H - n Li r Li <br /> jgl,nseRenewals; <br /> Raw Bar, Inc,_:. <br /> Selectman Vaccaro opened the Public Hearing to obtain comment. <br /> Attorney Ron Jansen representing the estate of Salvatore Virgilio <br /> requested the Board consider the possibility of conducting a hearing <br /> on the non--renewal of the Raw Bar's seasonal liquor license. <br /> Attorney Jansen stated that this matter is pending in the courts of the <br /> Commonwealth of Massachusetts as it relates to a wrongful death action <br /> suit as a result of alcohol being served at the Raw Bar establishment. <br /> There is direct correlation of the abuse and serving of alcohol to minors <br /> on the premises of the Raw Bar on the evening of issue in July of 1995 <br /> informed Attorney Jansen. <br /> On behalf of the Raw Bar,Attorney Clark requested the Board consider the <br /> mandate of the statute as it clearly states; the license shall be automatically <br /> renewed today. <br /> Selectman Vaccaro indic ated that a Hearing is scheduled on Monday, <br /> April 1, 1996 at 7:15 p.m. to show cause why the license should not be <br /> modified, suspended or revoked. Town Counsel will be present for the <br /> Hearing noted Selectman Vaccaro. <br /> Attorney Clark indicated for the record,he is in objection of the action <br /> to continue the Hearing in addition to the non-compliance of statute. This <br /> is a mandate that requires compliance tonight stated Attorney Clark. <br /> For the record, Selectman Caffyn indicated that she is disappointed that this <br /> meeting was held at such a late date. The Hearing was initially scheduled <br /> on January S, 1995. <br /> AttorneyJansen added that the Virgilio family is also concerned that it <br /> has taken this long to address such an important matter. <br /> Being no further comment, Selectman Vaccaro closed the Hearing,and <br /> requested a vote from the Board. <br />
