Page 20 <br /> t: <br /> Board of Selectmen <br /> Minutes--revised <br /> April 1, 1996 - <br /> Admini s 've Hearin z-Raw Bar,Ince.,- <br /> Sanctions that have been sustained by the ABCC include; <br /> Offenses within 2 years: Penalty <br /> First offense Warning-7 days <br /> Second offense Up to 30 days <br /> Third offense Up to revocation <br /> Bowen indicated that he is in <br /> Attorney o agreement with his brother counsel <br /> with respect to the charge violating Chapter 135, Section 34 by serving <br /> alcohol to a minor on July 14, 1995. <br /> The evidence is not substantial to find a violation indicated Attorney Bowen <br /> who recommended that the charges be dismissed. <br /> With reference f to the violation of Chapter 135, Section 34 on July 21, 1995 <br /> P <br /> Attorney Bowen indicated that there is clear violation based upon the <br /> testimonies' presented. <br /> Alcohol was served to a minor on July 21, 1995 indicated Attorney Bowen. <br /> Mr.Phares stated that Mr. Virgilio was a regular customer. Ms.Ellison <br /> was also a minor and was served. The bar tab was $150. There is no <br /> evidence that Ms.Ellison was carded noted Attorney Bowen,and there was <br /> no evidence that Mr. Virgilio was carded on the night he was killed. <br /> The second violation of October 29, 1995 for removing unsealed beverages <br /> from the premises of the Raw Bar is a major violation for the Board of <br /> Selectmen to determine indicated Attorney Bowen who noted the testimony <br /> of the State Trooper regarding this matter. <br /> P <br /> Being <br /> no further comment,Selectman Vaccaro closed the Administrative <br /> Hearing and requested a roll call vote from the Board of Selectmen. <br /> Motion made h Selectman Mills to declare that there has been <br /> cause shown to initiate discipline against the license holder <br /> of the Raw Bar Incorporated for violating the Massachusetts <br /> General Law; Cha ter 138Section 34, and Mashpee Liquor <br /> , <br /> License Regulations by serving alcohol to a minor on <br /> July 21, 1995. <br /> Motion seconded by Selectman Dinizio. <br /> VQT Unanimous. 5-0. <br /> Roll Call Vote: George, yes Peter, yes <br /> Nancy, yes Judy, yes Jim, yes <br />
