The evidence is not substantial to find a violation indicated Attorney Bowen who recommended that the charges be dismissed. With reference f to the violation of Chapter 135, Section 34 on July 21, 1995 P Attorney Bowen indicated that there is clear violation based upon the testimonies' presented. Alcohol was served to a minor on July 21, 1995 indicated Attorney Bowen. Mr.Phares stated that Mr. Virgilio was a regular customer. Ms.Ellison was also a minor and was served. The bar tab was $150. There is no evidence that Ms.Ellison was carded noted Attorney Bowen,and there was no evidence that Mr. Virgilio was carded on the night he was killed. The second violation of October 29, 1995 for removing unsealed beverages from the premises of the Raw Bar is a major violation for the Board of Selectmen to determine indicated Attorney Bowen who noted the testimony of the State Trooper regarding this matter. P Being no further comment,Selectman Vaccaro closed the Administrative Hearing and requested a roll call vote from the Board of Selectmen. Motion made h Selectman Mills to declare that there has been cause shown to initiate discipline against the license holder of the Raw Bar Incorporated for violating the Massachusetts General Law; Cha ter 138Section 34, and Mashpee Liquor , License Regulations by serving alcohol to a minor on July 21, 1995.
