i <br /> i <br /> � 4 � Town of Mas ee <br /> 16 Great Neck.load North <br /> AFjCE, Mashpee, Massachusetts 02649 <br /> BOARD of HEALTH - PUBLIC SESSION <br /> Minutes of the Meeting of July 6, 2017 <br /> Board Members present: Also Present: <br /> Brian Baurngaertelt Chair Glen Harrington, Health Agent <br /> Laurel Almquist, Co-Chair <br /> Chair Brian Baumgaertel called the meeting to order at 7:go PM. <br /> APPOINTMENTS ' <br /> 7:15 PM -- Nitrogen Aggregation Loading pian Bequest—Ockway Highlands. <br /> Glen Harrington stated that in duly of 2016, the applicant submitted a plan that had the open space highlighted <br /> on the definitive subdivision plan with no nitrogen loading calculations or stamp from a Professional Engineer. <br /> Mr. Harrington notified the applicant of the deficiencies and waited resubmittal of revised nitrogen aggregation <br /> plans. on May 30, 2017, the same colored definitive plan was submitted along with a separate sheet that <br /> included the nitrogen loading calculations computed by Tom Bunker of BSS Design. On ,dune 14, 2017, Mr. <br /> Harrington notified Toni Bunker that a third party review would be recommended. Today, Mr. Harrington met <br /> with Attorney Wall to discuss the requirements of the application and possible third-party review. <br /> Matt costa from Cape & Islands Engineering requested a copy of the plans from the Board of Health. He <br /> reviewed the plans and has issued a comment that he wishes-to become part of the record. <br /> Attorney Brian Wall, representing the applicant of ockway Highlands, introduced himself to the Board. <br /> Attorney Wall stated that he met with Glen Harrington and Mr. Harrington explained that the plan is incomplete <br /> since it requires the stamp of a Professional Engineer and a Registered Land surveyor. A third party review is <br /> suggested. Attorney Wall commented that his client feels it is expensive and time--consuming to review each <br /> individual lot. Attorney Wall believes that the Board should be able to make the decision without peer review. <br /> Mr, Harrington remarked that the guidelines are relatively clear for the requirements that the professional <br /> Engineer and the Registered Land Surveyor roust stamp a plan with specific calculations that become part of <br /> the plan. As far as the by-law regulation for the third party review and costa the Board had discussed having a <br /> different fee structure. The Board did not actually set a fee for the subdivisions. They merely set the fee for the <br /> single lot aggregation plans at $250.00. The Board was leaning towards requiring a third party review of the <br /> plans whether it is a Professional Engineer, a Registered Land Surveyor} or an attorney. Town Counsel would <br /> not be able to review the plans because if an issue should arise the Board of Health may need representation. <br /> Mr. Harrington will contact Town Counsel to discuss peer review. <br /> Brian Baurngaertel read the following email, as requested, from Matt Costa of Costa and Associates: <br /> "Glen, please include this email into the record as my written comments with regard to the above Board of <br /> Health application. In reviewing the nitrogen aggregation proposal at Town Hall for the above project, I would <br /> life to suggest that a minimum pian suitable for recording at the Registry of Creeds be prepared to accurately <br /> show the nitrogen credit areas and that any nitrogen credit areas that will be graded and planted as part of the <br /> road improvements not be included because those areas do not qualify as nitrogen credit land under the <br /> Department of Environmental Protection guidelines.
