L <br /> Draft Legislation - August Z, 1996 <br /> Amended October 30, 1996 <br /> } Not included in-,the transfer is land, buildings, fixtures and improvements <br /> located thereon owned by Barnstable County Government listed below: <br /> 1. Hospital Complex,Pocasset; �� <br /> 2. Helms House,Flint Rock Road.,Barnstable; <br /> 3. Police Service Center; <br /> 4. Fire Academy; <br /> 5. Route 132 Land; and <br /> 6. County Farm. <br /> (k) Not included in the transfer are buildings, fixtures and improvements of <br /> Property owned by Barnstable County Government listed below. <br /> 1. Sheriff's Residence; and <br /> 2. Communications building. <br /> Current and future uses located within these two buildings are entitled to the <br /> common use of the parking areas within the complex as may be necessary. Easements shall be <br /> provided in the event repairs and improvements to these buildings are necessary which requires <br /> the disruption of land transferred to the commonwealth under this act. At such time as the <br /> Sheriff's house is no longer used for correctional purposes, the use from that date forward shall be <br /> governed by the Cape Cod Regional Government. <br /> Such land and buildings described in sections 0} and (k) shall be exempt <br /> from local zoning ordinances provided the use of such land and buildings is. for commonly <br /> accepted governmental purposes. <br /> (1} Cape Cod Regional Government may occupy, without consideration, such <br /> space as is under the control of the Barnstable County Assembly of Delegates in the Barnstable <br /> county courthouses and Probate Court building as of July first, nineteen hundred and ninety- <br /> seven,or its equivalent,including common use of parking for a period of five years be ' g July <br /> first,nineteen hundred and ninety-seven. Not later than.February first, two thousand and two,the <br /> Assembly of Delegates shall provide to the house and senate committees on ways and means <br /> alternative location(s) for providing suitable quarters for the Cape Cod Regional Government, <br /> including fair compensation for moving expenses. <br /> (m) Notwithstanding any general or special law to the contrary,pursuant to this <br /> act the sheriff of Barnstable county in office June thirtieth, nineteen hundred and-ninety-seven, <br /> shall become an employee of the commonwealth under the secretary of public safety effective July <br /> first, nineteen hundred and ninety-seven. The sheriff shall remain an elected official under the <br /> general direction of the executive office of public safety. <br /> (n) Notwithstanding any general or special law to the contrary,pursuant to this <br /> act, effective July first, nineteen hundred and ninety-seven the commonwealth shall assume all <br /> financial control and responsibility over the Barnstable county jail and house of corrections and <br /> Barnstable county courthouse operations. The Cape Cod Regional Government shall retain control � <br /> of Barnstable county public safety functions other than the jail and house of correction which are <br /> outlined in Ordinance 90-16, The Barnstable County Administrative Code. These functions <br /> include but are not limited to Fire and Police Training Academy,and the communications services. <br /> (o) There shall be established a Cape Cod Regional Government Public Safety <br /> Board for the purposes of advising the Cape Cod Regional Government Board of Commissioners <br /> on the operation and management of the retained public safety functions. The membership of said <br /> Public Safety Board shall be comprised of the following; two representatives selected by the <br /> Barnstable County Fire Chiefs Association, two representatives selected by the Barnstable County <br /> Police Chiefs Association and one member representing Emergency Medical Technicians.
