Page 12
Board of Selectmen
Minutes
October 21, 1396
APPQI NTS AND HEARINGS:
Po ones t Cora, Obla Popponesset Inn-..Change of License:
Selectman Caffyn related concerns with respect to the private beach
and cabana clubs that are not open for public use. It was noted that
the Inn, and cabana club have been licensed as one unit since the 1930's.
The beach club,a new institution, is a seasonal business, and is included
in the subject license application.
Selectman Caffyn suggested the Board further address this matter
when renewing the license application. Selectman Frye agreed and
recommended that Town Counsel review the possibility of a second
license for the beach and cabana club.
In addition, Selectman Caffyn stated that the owner of the nominee trust
has not paid all outstanding taxes due to the Town to date. For the record,
Selectman Caffyn indicated that the applicant should pay all taxes when
requesting a change or renewal of license.
Selectman Caffyn recommended the Board further review the tax payment
issue. If residents owe taxes, we should not issue a license stated
Selectman Caffyn.
Attorney Gildea indicated that in his own individual capacity, the applicant
owes back taxes. Approval is at the discretion of the Board of Selectmen.
Mr.Whritenour noted that the bylaw addresses the license holder as it
pertains to the individual corporation. The applicant of the Popponesset Inn
does not owe any outstanding taxes pertaining to this establishment.
Selectman Marsters indicated that the Popponesset Inn employs many
local residents, and is an economical and viable entity for the Town of
Mashpee. He recommended approval.
Motion made by Selectman Marsters to approve the application
of Popponesset Corp., d/b/a Popponesset Inn, William
Zammer, Jr., Manager, to change their Seasonal All Alcoholic
Beverages Liquor License to an Annual All Alcoholic
Beverages Liquor License.
Motion seconded by Selectman Frye.
VOTE: Unanimous. 3-0.
Selectman Caffyn abstained.
