Article 18 <br /> To see if the Town will vote to amend the Zoning By-law as follows: <br /> Add the following new subsection: <br /> 174-30.1 Sight Obstruction <br /> To promote public safety at all Street intersections/corner lots in all Districts, no sign (except <br /> signs erected by the Town of Mashpee), fence, wall, hedge, or other visual obstruction, shall be <br /> maintained, installed, or erected at a height of more than two and one half (2.5) feet above the <br /> plane of the established grades of the Street within a triangular area on a corner lot formed by the <br /> Street layout lines twenty (20') feet distant from their point of intersection or, in the case of a <br /> rounded corner, the point of intersection of such lines as projected. <br /> Or take any other action relating thereto. <br /> Submitted by Board of Selectmen <br /> Explanation: This amendment to the Zoning By-law is intended to advance the purposes of <br /> M.G.L. Chapter 40A and the Zoning By-laws to regulate the location of buildings, structures and <br /> the uses of land in the Town to secure the health, safety and welfare of its residents; specifically, <br /> by prohibiting the maintenance, installation or erection of visual obstructions on that portion of <br /> corner lots proximate to street intersections where such visual obstructions could impair the <br /> ability of vehicle operators and pedestrians to safely negotiate and travel Town streets. This By- <br /> law would afford vehicle operators and pedestrians more time to react and improved sight lines <br /> when approaching intersections in the Town. <br /> The Board of Selectmen recommends Town Meeting approval by a vote of 5-0. <br /> The Finance Committee recommends Town Meeting approval by a vote of 4-0. <br /> After a public hearing held on October 5, 2016 the Planning Board voted 5-0 to recommend <br /> approval of Article 18. <br /> Motion made by Selectman Thomas O'Hara. <br /> Motion: I move the Town vote to approve Article 18 as written in the Warrant, with the <br /> exception of the phrase "or take any other action relating thereto." <br /> Motion passes unanimously at 7:30 PM. <br /> Article 19 <br /> To see if the Town will vote to amend the Zoning By-law as follows: <br /> Delete Subsection 174-33, Setback from water and wetlands. <br /> 13 <br />
