Explanation: This article would amend the zoning to C-2 Commercial, from R-5 Residential, <br /> on the lot on which the former "Flume" restaurant is located, as well as on an adjacent Town- <br /> owned lot abutting existing C-2 Commercial zoned lands. <br /> The Board of Selectmen recommends approval by a vote of 5-0. <br /> The Finance Committee recommends approval by a vote of 6-0, 1 absent. <br /> At its meeting on April 1, 2015, the Planning Board voted 3-0 to recommend approval of Article 18. <br /> Motion made by Selectman Andrew Gottlieb. <br /> Motion: I move the Town vote to approve Article 18 as printed in the Warrant, with the <br /> exception of the phrase "or take any other action relating thereto." <br /> Motion passes unanimously at 8:11 PM. <br /> Article 19 <br /> To see if the Town will vote to amend the Zoning By-law by amending Section 174-3.A. to add <br /> the following definitions, inserted in their proper alphabetical order location in said Section: <br /> "Pub Brewery or Brew Pub — A plant or premise licensed under Sections 12 and 19D of <br /> M.G.L. Chapter 138 where malt beverages are authorized to be produced and sold and where <br /> alcoholic beverages or wine or malt beverages only are authorized to be sold on the premises <br /> according to Massachusetts Alcoholic Beverages Control Commission regulations. The area <br /> used for brewing shall not exceed 30 percent of the gross floor area of the premise and <br /> production capacity shall be limited to not more than 5,000 barrels (a barrel being equivalent to <br /> 31 gallons)per year. Such establishment may also include a restaurant. <br /> Microbrewery — A facility for the production and packaging of malt beverages for distribution, <br /> retail or wholesale, on or off the premise, with a capacity of not more than 15,000 barrels (a <br /> barrel being equivalent to 31 gallons) per year and which may include a tap room where <br /> beverages produced on the premises may be sold and consumed. May include other uses such as <br /> a restaurant, including outdoor dining, or live entertainment if otherwise permitted in the zoning <br /> district." <br /> And by amending the Section 174-25 Table of Use Regulations to add a new Subsection E.(15) <br /> "Pub Brewery or Brew Pub" and indicating by the letters "SP" under the C-1, C-2, and C-3 <br /> columns that such use may be permitted by Special Permit in those zoning districts, and to add a <br /> new Subsection G.(15) "Microbrewery" and indicating by the letters "SP" under the C-1, C-2, <br /> C-3 and I-1 columns that such use may be permitted by Special Permit in those zoning districts; <br /> or take any other action relating thereto. <br /> Submitted by the Board of Selectmen and Planning Board <br /> Explanation: This article would amend the zoning by-law to allow pub breweries or "brew <br /> pubs" and microbreweries in certain zoning districts by Special Permit. <br /> 20 <br />
