Dami Town Clerk Town of Mashpee 16 Great Neck Road North Mashpee, MA 02649 RE: Mashpee Fall Annual Town Meeting of October 15, 2012 - Cases # 6525 and 6571 Warrant Articles # 8, 9, 10, 11 and 12 (General) Dear Ms. Dami: Article 8 - We approve the amendments to the Town's by-laws adopted under Article 8 on the Warrant for the Mashpee Fall Annual Town Meeting that convened on October 15, 2012. On November 7, 2012, the Town submitted a by-law package to the Attorney General from the October 15, 2012 Fall Annual Town Meeting and that submission was assigned Case # 6525. Article 8 was omitted from that original by-law submission. As such, on November 30, 2012, when the Town submitted Article 8 from the October 15, 2012 Fall Annual Town Meeting, it was assigned a separate number (Case# 6571). Articles 9, 10, 11 and 12 - We remind the Town that on November 7, 2012 this Office issued a decision approving Articles 9, 10, 11 and 12 from the October 15, 2012 Fall Annual Town Meeting in Case # 6525. Note: Pursuant to G.L. c. 40, § 32, neither general nor zoning by-laws take effect unless the Town has first satisfied the posting/publishing requirements of that statute. Once this statutory duty is fulfilled, (1) general by-laws and amendments take effect on the date these posting and publishing requirements are satisfied unless a later effective date is prescribed in the by-law, and (2) zoning by-laws and amendments are deemed to have taken effect from the date they were approved by the Town Meeting, unless a later effective date is prescribed in the by-law.
