Torrey and Patricia A. Torrey Bk: 3668 <br /> 23 Treasure Lane (Map 96 Parcel 101) Pg.: 244 <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 7, 2019 by Owners, Paul F. and Patricia Torney <br /> requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a <br /> pre-existing non-conforming single family structure on property located in an R-3 Zoning <br /> District, Map 96 Parcel 101, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 22, 2019 and March 1, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,March 13,2019 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Scott Goldstein, Norman J. Gould, and Associate Member, Sharon Sangeleer. <br /> Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Steve Cook, Project Designer with Cotuit Bay Design represented the Torney <br /> family for their raze and replace project. The existing house was built in 1962 and does not <br /> have insulation. The existing house foundation consists of concrete blocks and sits on a <br /> 10,000 sq. ft. lot with 100 ft. of frontage. The Tomey's would like to build a new home <br /> that will meet current building code requirements,and that will accommodate their growing <br /> family. <br /> The proposed new dwelling will be a single story home with a full basement. The <br /> front yard setback is 35.2 ft. and includes the average of the house next door and the vacant <br /> lot on the other side which is 31.2 ft. The side setback on one side is 19 ft. and the other <br /> side is 22.7 ft., so this project will meet the setbacks. The rear is 36.9 ft. The current lot <br /> coverage is 13.6%,and the proposed will be 13.8%which is within the requirement.A new <br /> septic system will be installed versus the existing cesspool. The Town adopted this new <br /> bylaw back in October 2018 for raze and replace projects.This particular project falls under <br /> that bylaw for a Special Permit. The Board must find that the proposed reconstruction of a <br /> new dwelling will not be substantially more detrimental to the neighborhood than what <br /> currently exists, and there will be plenty of parking as required. <br /> 1 <br />
