Herbert and Doc. #: 957658 <br /> Christine Herbert Ctf: # 172113 <br /> 42 Spoondrift Way Lot: 146 <br /> (Map 111 Parcel 127) Plan: 11408-24 (sheet 1) <br /> Mashpee, MA 02649 <br /> A Petition was filed on January 23, 2019 by Owners, William M. and Christine <br /> Herbert requesting to reestablish a 2017 Variance (V-2017-01) that was granted for relief <br /> from the side yard setback under §174-31, and under §174-33 from water and wetlands to <br /> allow for construction of a detached garage on property located in an R-3 Zoning District, <br /> at 42 Spoondrift Way, Map 111 Parcel 127, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 1, 2019 and February 8, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 27, 2019 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, and Norman J. Gould, and Associate Member, Sharon <br /> Sangeleer. <br /> Owners, William and Christine Herbert represented themselves to reestablish a <br /> Variance that was issued back in 2017 to construct a detached garage. The Variance was <br /> approved by the Board, however the construction was not initiated which required a new <br /> Zoning application. <br /> Mr. Bonvie asked the homeowners if there were any recent changes made to their <br /> plans, and what their situation was with the Conservation Department. <br /> Ms. Herbert said nothing has changed on the plans,but they will need to also return <br /> to the Conservation Department because the Order of Conditions had also expired. <br /> 1 <br />
