'Tongn of Alashpee <br /> h 0 <br /> 16 Great JYeck f oad JN`orih <br /> , IMassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2019-13 <br /> Frederick J.Naddaff, Jr. and Doc.: 1314997 <br /> Linda Naddaff Ct£: 212079 <br /> 29 Overlook Knoll Road <br /> (Map 118 Parcel 33) <br /> Mashpee, MA 02649 <br /> A Petition was filed on January 25, 2019 by Owners, Frederick J. and Linda <br /> Naddaff requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and <br /> replace a non-conforming single family structure on property located in an R-3 Zoning <br /> District,and the Popponesset Overlay District,at 29 Overlook Knoll Road,Map 118 Parcel <br /> 33, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 1, 2019 and February 8, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 27, 2019 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members, Ron Bonvie, and Norman J. Gould, and Associate Member Sharon <br /> Sangeleer. <br /> Attorney Kevin Kirrane represented the homeowners for their raze and replace of <br /> a single-family structure that bounds Seaview Ave and Overlook Knoll Road, and <br /> Nantucket Sound. Mr. Kirrane said that the process started over a year ago as a result of <br /> the issues concerning the revision of the Zoning Bylaw relative to raze and replace projects. <br /> It was deferred until the time the bylaw was changed and approved by the Attorney <br /> General's office. <br /> Mr. Kirrane provided the Board his photographs of the general Popponesset area as <br /> well as photographs of the building in the immediate neighborhood, a site plan, and <br /> building plans. These lots typically found adjacent to Nantucket Sound tend to be larger <br /> than the other lots in the area. The minimum lot size requirements are 6,000 sq. ft., with <br /> 125 ft. of frontage. This lot is 11,000 plus which exceeds that minimum, and exceeds the <br /> frontage at 160 plus feet along Overlook Knoll Road. <br /> 1 <br />
