A)rth . <br /> UCzApee,'Wils4{arhusOls 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 23, 2019 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, January 23, <br /> 2019, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road <br /> North. Chairman, Jonathan D. Furbush, Board Members William A. Blaisdell, Ronald <br /> Bonvie, Scott Goldstein,Norman J. Gould and Associate Member, Sharon Sangeleer were <br /> present. Building Commissioner, Michael Mendoza was also present. <br /> PLEDGE OF ALLEGIANCE <br /> Chairman Furbush opened the meeting at 6:00 pm and announced that the hearings were <br /> being televised live on Mashpee TV. <br /> PUBLIC COMMENT <br /> Matthew Haney, Trustee of Gooseberry Island Trust. He said he has an open meeting law <br /> complaint for the Chairman, and his second item is his understanding that the Agenda has <br /> an Executive Session,and he just wants a point of order. He said under the statute,the open <br /> meeting law statute. Chairman Furbush interjected and said to Mr.Haney to save him some <br /> time the Board will not be going into Executive Session tonight. Mr. Haney said; okay that <br /> he wanted to make a statement. Mr. Haney said you can only go into Executive Session to <br /> discuss strategy with respect to litigation only if an open meeting may have a detrimental <br /> effect in the litigation position of the public body. The key is that the position to having an <br /> open meeting has to have a detrimental effect. In other words, if you're discussing <br /> something in Executive Session, and it doesn't have a detrimental effect in an open <br /> meeting,then you cannot bring it into Executive Session. He said he thinks the discussions <br /> should really be an open meeting. He thanked the Board and left the room. <br /> EXECUTIVE SESSION <br /> Chairman Furbush said he is not going to entertain a motion to go into Executive Session <br /> at the advice of Town Counsel because it is not needed at this time. <br /> Chairman Furbush announced that they would now open up the hearings. <br /> Sitting on the first hearing will be the five regular Board Members. He is moving the order <br /> of the Agenda by one hearing to place 23 Halyard Lane on first because of a time conflict <br /> request by Steve Cook who is representing this case. <br /> 1 <br />
