MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> James and Nancy Mayou <br /> 317 Great Neck Road N. (Map 52 Parcel 20) <br /> Mashpee, MA 02649 <br /> SP-2019-03 <br /> Nancy said that the last bedroom closest to the furnace next to the bathroom would <br /> be the better option to make a 6 ft. opening. The Board discussed the options and asked the <br /> applicants if they were satisfied with the adjustments to their floor plan. <br /> Mr. Mendoza said if the Board agrees to approve the Special Permit that there be a <br /> condition to have the Fire Department make an inspection to make sure all the proper <br /> smoke detectors, and carbon monoxide detectors are in place in the accessory apartment. <br /> Sharon read the Inspection Department comment into the record. Mr. Furbush read <br /> the Board of Health comments into the record that he reviewed the two options for the <br /> accessory apartment, and both are acceptable. There were no comments from <br /> Conservation. <br /> Mr. Furbush commented to the applicants that if they sell the house, then the new <br /> owners will have to reapply with the ZBA for the accessory apartment. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, January 23, 2019, the Zoning Board of Appeals voted unanimously to issue a <br /> Special Permit to James and Nancy Mayou for an accessory apartment with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. A Floor Plan provided by James and Nancy Mayou, 317 Great Neck Rd., N., <br /> Mashpee, MA. Depicting the driveway with the following changes. The Floor Plan <br /> will be Plan A, the depicted dining room will be converted into a storage room <br /> which will be non-habitable space as approved by the Zoning Enforcement Officer <br /> as to how it will be created, i.e. a 6 ft. opening of the doorway. <br /> 3. Conditioned on all Town Department comments read into the record. <br /> 4. Conditioned that the Fire Department does an inspection of the dwelling and meets <br /> all requirements of the Fire Department prior to occupancy. <br /> 5. Conditioned that the Special Permit runs with the property owner and shall lapse <br /> upon sale and/or transfer to another property owner as noted under the bylaw. <br /> 2 <br />
