Tougn of f'Nlashpee <br /> 16 Creatceck &)ad ,kbrth <br /> Afashjx(�,Massachusetts 021649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2019-07 <br /> Michael B. and Elizabeth Iacobucci Doc.: 872987 <br /> 59 Uncle Edwards Road Ctf: 165351 <br /> (Map 117 Parcel 219) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 5, 2018 by Owners, Michael and Elizabeth <br /> Iacobucci requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for <br /> an addition,extension of a pre-existing non-conforming structure on property located in an <br /> R-3 Zoning District, and the Popponesset Overlay District, 59 Uncle Edwards Road, (Map <br /> 117 Parcel 219), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on December 14, 2018 and December 21, <br /> 2018 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,January 9,2019 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Member,Norman J. Gould, and Associate Members, Brad Pittsley and Sharon Sangeleer. <br /> Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Steve Cook, Cotuit Bay Design represented the homeowners for the proposed <br /> addition. They would like to construct a family room, and a new deck on the rear of the <br /> house. The existing house is non-conforming due to the left property line which is 14.2 ft. <br /> versus 15 ft. The new family room will be 15.2 ft. of the left property line, and will re-build <br /> the deck. The shed in the rear will be relocated. The left side of the'house is 16.3 ft. the <br /> front is 24.4 feet, and is well over the 25.3 ft. in the rear. The lot coverage is currently <br /> 25.3%, and will be dropped to 24.7%. The lot coverage percentage requirement in the <br /> Popponesset Overlay is 25%. Steve said that a portion of the deck is covering some of the <br /> SAS leach field that is based on the as-built from the surveyor. That will be cantilevered <br /> over and the footings will be outside that area. There's a second floor on the right hand <br /> side of the property that is being added as well. <br /> 1 <br />
