There being no further comments or questions, Laurel Almquist moved continue discussion of the septic <br /> variances at 81 Seconsett Point Road until the next meeting on March 7, 2018, provided evidence of the <br /> number of legal bedrooms is available. Motion seconded by Mallory Langler, VOTE: Unanimous (3-0). <br /> OLD BUSINESS <br /> 1. Discussion of Draft Innovative/Alternative Septic Regulation, Mr. Harrington commented that <br /> the board has been reviewing this amended regulation for some time. Comments were made but <br /> there had been no real changes until now. In the amended version that was provided to the <br /> board, the following changes were made: 1) add a Remedial Use Approval definition, 2) add a <br /> requirement for a denitrification system at 75' along with the existing ultraviolet light <br /> requirement, 3) remove the monitoring requirement of two years of quarterly nitrogen testing <br /> and replace with the DEP approval letter requirements for each system, with an option to make <br /> the general and remedial approved systems have operation and maintenance two times a year, <br /> with field testing only, 4) add a requirement for effluent tee filters, 5) add a sampling point <br /> requirement, and 6) add a requirement for reporting of water use. <br /> Chair Baumgaertel stated that,when looking at these applications,it would helpful to know which <br /> phase of the sewering plan the properties are in. He asked, when an I/A system is installed in a <br /> Zone II but is not installed to mitigate increased nitrogen loading, is it subject to that part of the <br /> regulation requiring quarterly testing. Michael McGrath commented that all systems are <br /> supposed to meet the requirements no matter where they are installed; however,the regulation <br /> does allow a transition from quarterly to annual testing after a certain number of successful tests <br /> are conducted. <br /> There being no further comments or questions, Mallory Langler moved to continue discussion of <br /> the Draft Innovative/Alternative Septic Regulation to the next meeting on March 7,2019. Motion <br /> seconded by Laurel Almquist. Vote: Unanimous(3-0). <br /> 2. Discussion of Draft Recreational Marijuana Regulation. Chair Baumgaertel indicated that the <br /> Board of Selectmen are still in the process of reviewing and considering applications. The Town <br /> Manager had appointed Chair Baumgaertel and Mr. Harrington to the sub-committee. Mr. <br /> Harrington recommended they hold off on sharing any documents provided to them as sub- <br /> committee members until authorized by the Selectmen. <br /> Mr. Harrington provided the following information In response to the board's requests for <br /> clarification at the previous meeting: 1) the definition of "transaction" — if there's an <br /> understanding that purchases may be made online but product delivery must be face-to-face, it <br /> still meets the intent of the regulation; 2)are"stings"considered one of the required inspections <br /> -there did not appear to be anything in the regulation indicating that"stings" met the criteria for <br /> inspection,but Mr.Harrington was waiting for an opinion from the state;3)does the requirement <br /> for 500' buffer between the marijuana establishment and schools, playgrounds etc. extend from <br /> structure to structure or property line to property line—this section of the regulation was written <br /> by Town Counsel based upon the by-law,and the term "grounds" refers to the property lines. <br /> Mr. Harrington Informed board members that he added "research facility" to marijuana <br /> establishment because it wasn't in the original definition. He also Inserted 21 as the minimum <br /> sales age. He stated that, while there is currently an option to get a delivery permit, he <br /> recommended deleting that portion until the state has provided more guidance. He further <br /> 3 <br />
