F <br /> P <br /> KA H EE WATERWAYS -COMMISSION <br /> SPECIAL, MEETING IIT NINUTES 'T HE 2 , 1995 <br /> COMMISSIONERS PRESENT* , Jim Hanks , Ben Gordon, Herb Silver, <br /> Fred Fordham, Dan Home rer, Don Lund, William Rowland. <br /> Also present: Perry Ellis , Harbormaster <br /> CALIF TO ORDER; The meeting was called to order at 7 : 05 p.m. <br /> Mr. Hanks stated the purpose of the meeting tonight is to hold <br /> a public . heatring o the revised Waterways By Laws , Article 1 <br /> at - the October 2 , 1995 Town Meeting, and Mr. Silver who chaired <br /> the By Laws sub -comm-ittee will walk everyone ' through the chances <br /> once and discussion will follow, Mr. Hanks noted that Ir. <br /> Homeyer and Harbormaster Perry Ellis also ror] ed on these By <br /> Law changes, as well as himself and Nor. Silver. Mr. Hanks turned <br /> the floor over to Mr. Silver, - who began by stating that Waterways <br /> Commission drafted a revised set of Waterways By Laws for the <br /> purpose to adopt the pertinent portions of Mass . General Law <br /> B and 91 into Chapter 170 of the Town of Mashpee Code so that <br /> when enforcement officers issue itations for violations of <br /> the By Laws the revenue will accrue to the town. As it is now <br /> the officers use two ticket books , the Commonwealth ' s ticket <br /> book does not accrue to the Town. The second purpose in changing <br /> these is to attempt to simplify the language, making the laws <br /> easier to understand, and eliminate redundancy. Ir, Silver <br /> then went through step by step noting the changes as follows : <br /> —Pace 1, The table of contents has been increased. The old <br /> 170-8 Posting of signs has been changed to Divers and diving. <br /> Personal watercraft operation ( 170-6.) has been added. <br /> - Page 3 , 170-3 Enforcement; violations and penalties. The <br /> fines are spelled out in the present -version. The change is <br /> that the Harbormaster shall set a fine schedule set forth <br /> in regulations promulgated by the Harbormaster and approved <br /> y the Board of Selectmen. The purpose is so that we do not <br /> have to go through Town Meeting to increase or decrease a <br /> violation. <br /> - Pace 3 , 170-4 Speed. "Slow, No wake" is spelled - out and <br /> and what it means . <br /> Pace 4 , 170-5 Waters iinc . Added to this is tubing and <br /> ] eeboardinc .. Restrictions and prohibited activities are <br /> listed. Dr. Gordon noted under B b. "drawing" should be <br /> towing. Mr. Silver read the original which used "drawing. " <br /> Mr. Hanks stated no chances can be made until Town Meeting. <br /> 'Ir. Silver read off the prohibited bodies of tidal water, <br /> Great Iii-ver, Little River, Santuit River, Mashpee River, <br />
