HEARINGS: <br /> 6:00 Paul A. & Cynthia A. Jalbert, 43 Monahansett Road. Proposed landscape and <br /> hardscape modifications. At request of applicant, continued from 2/14, 3/28 — mitigation <br /> plan required. RDA <br /> Motion: Mr. Sweet moved at the request of the applicant to continue the hearing to May <br /> 9, 2019 at 6:00 p.m., seconded by Mr. Dalton. Vote unanimous 4-0 <br /> 6:03 Kevin H. & Maryellen M. Kelley, 123 Tide Run. Proposed expansion of deck on <br /> existing dwelling. At request of applicant, continued from 3/28 — mitigation plan <br /> required. NOI <br /> Resource Area: Buffer zone to coastal bank, BVW, salt marsh, Land Under Ocean and <br /> ACEC. <br /> Ken Kenneth Breivogel, J. E. Landers-Cauley, represented the applicants. He stated they have <br /> submitted a revised plan and discovered there are two open Orders of Conditions on this property. The <br /> project consists of removing a patio and two stonewalls and extend the deck to the northern side of the <br /> house. They are proposing plantings as shown on the plan. There will be a foot passage way around <br /> the house. <br /> The Agent noted the bylaw requires investigation of previous permits that have not been closed out via <br /> a certificate of compliance. One was for the construction of the home in 2004 and the mitigation was <br /> never conducted so mitigation was updated and slightly increased. <br /> No comment from the public <br /> Motion: Mr. Sweet moved to Close and Issue, seconded by Mr. O'Neill. Vote unanimous <br /> 4-0 <br /> 6:06 Larrson Family Trust, 72 Captains Row. Proposed replacement of existing <br /> structure with construction of pier, ramp and floats. At request of applicant, continued <br /> from 3/28 to allow for DEP review. NOI <br /> Resource Area: Land Under Ocean, Salt Marsh, Coastal Bank, Coastal Dune, LSCSF, <br /> LCS <br /> Ed Pesce, Pesce Engineering, represented the applicant. He stated they have received the <br /> DEP File number. He discussed the size of the float area proposed to reduce the size of the <br /> floats from 8' by 20' to 8' by 18' and the 6' by 12' to a 3' by 12' for a total of 180 square feet. In <br /> addition, the staff has researched previous Order of Conditions and there are four open Order <br /> of Conditions. One was the house addition that was never done and the other was for the <br /> seawall and the septic system. He noted he will prepare a revised plan. <br /> The Agent stated the closing of the open Order of Conditions is a housekeeping item and the <br /> applicant will proceed to close them out. The Agent commented at the last meeting there was <br /> discussion on mitigation and he clarified the updated portion of mitigation for docks and piers is <br /> in full effect and does not have to go to the Board of Selectmen for review. The only thing that <br /> has to go before the Selectmen is how to deal with it accounting wise. A special fund has to <br />
