MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 22,2019 <br /> Mr. Bonvie was most concerned with the ownership of the driveway and/or roadway. He <br /> said that Charlie Rowley mentioned in his letter that it meets local and State highway <br /> criteria in the design and/or a subdivision road. In the application, there's mention of <br /> condominium ownership, and to have that driveway be a common area with no need of <br /> easements, etc. Mr. Bonvie asked if the applicant would be willing to discuss the <br /> application to Charlie Rowley. Mr. Brodie said; yes, it's just lines on the ground to create <br /> that right of way and have the ownership of that in the homeowner's association. <br /> Mr. Bonvie asked the applicant if he feels confident and willing to sit down with Mr. <br /> Rowley and comply with his request, and modify the plans to meet his request. Mr. Reedy <br /> said; yes as it pertains to the roadway. Mr. Bonvie asked if there was anything in the letter <br /> that they felt they would not be able or not willing to comply with. <br /> Mr.Reedy said after reviewing Mr. Rowley's detailed site review letter dated May 7,2019, <br /> his proposed changes to the drainage facilities will accomplish the same goals. Mr. Reedy <br /> said his method is a stone and grass swale to collect debris. Mr. Reedy said instead of <br /> having a leach pit in the lower area that has a grade, it would have a closed cover and the <br /> pipe would run directly to it. <br /> Mr. Bonvie asked if there would be a problem if the Board saw in its wisdom to approve <br /> the application with the following;"that it would be subject to Charlie Rowley's approval". <br /> Mr.Reedy said that it might be that Charlie Rowley was not looking at the existing drainage <br /> facility that is also on the site plan within the road layout. There is an existing drainage <br /> facility that the DPW mentioned in their comments.Mr.Bonvie asked if they did a drainage <br /> study. Mr. Reedy said yes. The calculations are for a 25 year storm. The main difference <br /> between Charlie Rowley's plan and the proposed plan is that the proposed drainage facility <br /> will also allow for collection of ground surface of water that is not just on the paved surface. <br /> The DPW is concerned about protecting the drainage facility. The proposal is to limit the <br /> amount of work around the property line to ensure there are no erosion issues during <br /> construction. But they also want to provide some storm water solutions in addition to what <br /> is on the pavement so they can collect some of the storm water that will naturally run down <br /> the site. Mr. Bonvie asked if the Board saw fit to approve the application with a condition <br /> noted that states; that you will meet with Charlie Rowley and between the two of you and <br /> your team that would satisfy his concerns; would that be acceptable. Mr. Reedy and <br /> Attorney Brodie said; yes. <br /> Chairman Furbush likes the project but there's concerns with Charlie Rowley's report. <br /> 6 <br />
