MASHPEE ZONING BOARD OF APPEALS DECISION FOR A WRITTEN FINDING John F. Gavin and Terese J. Gavin 150 Pimlico Pond Road (Map 2 Parcel 136) Mashpee, MA 02649 FINDING-2019-34 4. Construction of the dwelling is contingent upon Board of Health final approval. 5. Construction of the dwelling will conform to current building code requirements. 6. There is adequate land area to provide sufficient parking and setbacks as may be required. In view of the foregoing, the Board determined the Petitioner met the criteria for a Written Finding. Upon motion duly made and seconded at the Public Hearings on Wednesday, June 26, 2019, the Zoning Board of Appeals voted unanimously to issue a Written Finding to John F. Gavin and Terese J. Gavin of 150 Pimlico Pond Road to allow for construction of a bathroom in a detached garage on property located in an R-5 Zoning District, Map 2 Parcel 136, Mashpee, MA; with the following conditions; 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Referencing a Title 5 Site Plan, 150 Pimlico Pond Road, Mashpee, MA. Prepared for John and Terese Gavin, dated May 20, 2019, Revised: June 21, 2019 (Inland Bank), Scale: 1" = 20', prepared by: Down Cape Engineering, Inc., and signed by Dan Ojala, PE dated: 6/21/19. 3. Referencing a House Plan: G1.0: Garage Plan, G2.0: Garage Elevations. 4. Conditioned on all Town Department comments read into the record. 5. Conditioned that the garage is a one story structure, there will be no sleeping quarters allowed, no shower allowed, no living quarters allowed, and no kitchen allowed. When the applicant submits the permit application to the Building Inspector, the truss shop drawings will clearly depict the inability to add a second floor of this garage. The bathroom will only include a sink and toilet. 4
