The site plan is dated <br /> 3/21/2019 by J. M. O'Reilly & Associates, Inc. of Brewster, MA. A second plan <br /> entitled "Definitive Subdivision Plan of Land" is dated January 31, 2019. <br /> Definitive Subdivision Plan <br /> 1. The plan has been prepared as part of a 40B application to divide an <br /> existing lot into two parcels, each of which would presumably be the site <br /> of a single-family dwelling. <br /> 2. The application is under Chapter 40B, which gives the Board of Appeals <br /> broad latitude to approve a plan that does not fully comply with a <br /> subdivision as described in Chapter 41, Section 81 L. <br /> 3. The plan shows two lots, each of which have frontage on Great Neck Road <br /> North. The front lot has 127.00 feet of frontage. The rear lot has 31.45 <br /> feet of frontage on Great Neck Road North. This latter contains a <br /> proposed driveway which would serve as access for each lot. <br /> 4. The plan is similar to a "Form A" or Approval Not Required Plan under the <br /> Mashpee Subdivision Rules and Regulations except for the overall lot size <br /> and frontage. <br /> Zoning District R-5 Lot Size Required 80,000 s.f. <br /> Lot A Proposed 21,720 s.f. including driveway <br /> Lot B Proposed 17,978 s.f. <br /> Lot A and Lot B Frontage Required 150 ft. <br /> Lot A Frontage Proposed 31.45 ft. <br /> Lot B Frontage Proposed 127.00 ft. <br /> 5. For the plan to be a subdivision it would make sense to separate that <br /> portion of Lot A from the driveway portion of the lot so that the driveway <br /> becomes a street. In that way the applicant could ask for certain waivers <br /> under the Mashpee Subdivision Rules and Regulations for road <br /> construction. In practical terms Lot A would then have 15,198 feet of area <br /> and approximately 102 feet of frontage on the proposed street. <br /> Requested waivers should be spelled out in writing. <br />
