Hodgson Pg.: 154 <br /> 17 Cedar Street <br /> (Map 77 Parcel 37) <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 27, 2019 by Owners, George L. and Kathleen J. <br /> Hodgson requesting a Variance under §174-33 of the Zoning Bylaws to allow for <br /> construction of an elevated stairway to a dock situated within the wetlands resource area <br /> on property located in an R-3 Zoning District, at 17 Cedar Street, Map 77 Parcel 37, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 8,2019 and March 15,2019 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,March 27,2019 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Member, Ron Bonvie, and Associate Member, Sharon Sangeleer. <br /> Mr. Wayne Tavares, Landscape Architect with Wet Tech Land Design, Inc. <br /> represented the Hodgson's for their dock and stairway project. He has already received <br /> approval with Conservation,and went through the State permitting process.After speaking <br /> with the Building Inspector, it was discovered that the project requires a filing within the <br /> 50 ft.buffer. The stair structure is needed to reach the dock. The lot coverage is 14.7%with <br /> the stairs, and 14.1% prior to the stairs. The setbacks on the side line 37 ft. and does not <br /> intrude on the side setback. It's a structure that is needed, and will require the removal of <br /> three trees on the coastal bank. The footings on the stairs have been discussed with the <br /> Building Department. There's approximately 43 steps to the deck, and it's a 91 foot <br /> stairway that has 10 landings, and meets the code of with no more than 12 steps. The risers <br /> are very generous with the treads. The drop is 35 ft. to the top of the rock wall. <br /> 1 <br />
