"What oc- <br /> curred in the past relative to the installer not attaching a <br /> lien or suing the individuals for what was contracted is not <br /> an issue. "The issue with the installer is not an issue <br /> with Mr. Melroy nor -the bank. " "The installer must find re- <br /> lief for his particular case elsewhere, 11 <br /> I <br /> Mr*. Greelish explained, <br /> this issue hasoccurred before <br /> with both private and town awned property. ' The technical <br /> problem is the system must be certified, " "Installer's have <br /> held the 'AAs Built" as a mechanics lien, " Mr. Greeks <br /> stated he is not prepared to render a decision as this Board <br /> has established a policy and to find any other mechanism <br /> would be counter to that established policy. " "I would rec- <br /> ommend <br /> ec- <br /> omme d this Board seek Town Counsel's opinion. " <br /> Board members agreed to request Town Counsel's opinion <br /> on this matter. <br /> Mr. Greelish continued this matter until such time as <br /> Town Counsel has rendered an opinion. <br /> Se is permitextension request - "Bluff Cottages" <br /> 1bMr. Brian Zeppenfeld was in attendance for this sched- <br /> tiled appointment. <br /> Mr. Zeppenfeld stated he is present this evening to re- <br /> quest Board members reconsider their gate to deny a one year <br /> extension for septic permits issued to the Bluff Cottages. <br /> "The Conservation Commission is favorable to the one year <br /> extension as this is an environmentally sensitive area. " <br /> Mr. Greelish recommended the engineer and a health agent <br />' witness installations. <br /> Mr. ,Doherty motioned rescind the Board's motion of <br /> September 3 . 1991 to dere an extension of the septic permits <br /> issued to the Blue Cottages, Mr. Ball seconded, all agreed. <br /> Mr. Doherty motioned to grant an extension of the septic <br /> permits issued to the Bluff Cottages with expiration elate of <br /> Deember 31 , 1932 with the stipulation a health agent and the <br /> engineer witness installation of each leaching facility ser- <br /> icing the Blue Cottages, Mr. Ball seconded, all agreed* <br /> ' .
