Suggestion:make it two hours for <br /> an emergency only. <br /> 3 Board of Health conditions for issuance of a certificate in C.3 <br /> If we are creating greater regulation,which can go either way at town meeting,we should <br /> create as much predictability and clarity as possible.Therefore,whatever conditions the BOH <br /> would apply should be spelled out in the bylaw,As written,that section leaves the bylaw open <br /> to interpretation by future Boards of Health to either be more,lenient or more stringent than <br /> town meeting voters intended. <br /> Comment: .The board realizes that every property is different and has certain idiosyncrasies <br /> that may need to be addressed as a condition of the rental certificate. This section could be.just <br /> left to possibly setting conditions if variances from-the by-law are requested but there is no <br /> variance section in the by-law. I would revise that section to add at the end: "in relation to <br /> parking,refuse,food, the Building and Fire Codes." This way the conditions are only <br /> applicable to topics within the by-raw. <br /> 4 Number of bedrooms and number of ersons allowed in C1 <br /> There should be language clarifying which.state or local health and safety rules would be <br /> applied.For example,property owners may be fine with the town applying the Title v and fire <br /> code,but there may be concerns from residents about what,if any, other existingor future <br /> regulations would be enforced.As with C3,this paragraph leaves the bylaw open to <br /> interpretation by future Boards of Health to either be more lenient or more stringent than town <br /> meeting voters intended. <br /> Comment: Theapplicable regulations for setting the number of occupants and number of <br /> bedrooms for the BCH purposes are Chapter I1 of the State Sanitary Code 105 CMR 410.000, <br /> Title V of the State Environmental Code 310 CMR 1.5.000, The State Building Code and the <br /> State Fire Marshall's Code. I do not know of--any local by--laws that would apply to numbers of <br /> bedrooms or occupancy. <br /> 5) Definition of agent in B5 <br /> As written, a real estate broker or agent who leases a property could be considered the owner <br /> and held liable for the requirements of the bylaw.In practice,real estate agents only serve as a <br /> conduit between the owner and lessor for the purposes of executing a contract(lease).We <br /> should change the word"agent" to be "owner's representative'" to be explicitly clear about <br /> what we mean, <br /> Comment; I am good with that. <br /> I would appreciate your feedback on revising these sections to incorporate the concerns <br /> outlined above,if possible,by Thursday evening. <br />
