Conditioned upon satisfaction of all Board of Health comments and outlined <br /> correspondence submitted to the Board prior to the submittal of an application of a <br /> building permit to the Building Department, and Building Inspector. <br /> Mr. Gould, second <br /> Mr. Goldstein,yes, <br /> Mr. Blaisdell, yes, <br /> Mr. Furbush, yes. <br /> All were in favor of the raze and replace project. <br /> 21 Evergreen Circle: Petitioner, Thomas E. Fair requests a Special Permit under §174- <br /> 25 (G) (4) (6) (14) to allow for construction of a contractor bay warehouse with an <br /> accessory office on property located in an I-1 Zoning District,Map 19 Parcel 10,Mashpee, <br /> MA. (Owner of Record: Evergreen Energy, LLC). <br /> Attorney Kevin Kirrane represented the Petitioner, Tom Fair in connection with the <br /> application for a Special Permit. Also present was Dan Ojala, Down Cape Engineering, <br /> and Mr. Fair who is the prospective owner of the property. This project is similar to other <br /> projects the Board has approved in the past in an industrial zoned areas. This area is newly <br /> developed located off of Rte. 130, and is a brand new subdivision roadway called <br /> Evergreen Circle. <br /> The building itself conforms to all required setback criteria and has adequate parking on <br /> the site to address the parking needs. There is appropriate drainage swales and basins as <br /> required under the bylaw. The building itself will consist of four units. The proposal <br /> includes three contractor bays that are 1,000 sq. ft., and the remainder of the building will <br /> be occupied Tom and Margaret's business. The lot itself is a 43,000 sq. ft. lot with 200 ft. <br /> of frontage on Evergreen Circle and conforms to the zoning requirements. The proposal <br /> itself is to construct a 7,000 sq. ft. of leasable space. <br /> The applicants have been operating Fairway Lawn and Tree business for quite a while. <br /> Their base operation is located in Harwich, MA. However, their business has expanded <br /> and they are servicing more clients on the other side of the canal. So this building will <br /> provide their base'operations to service their customers on the upper Cape and over the <br /> bridges. <br /> The building itself is located in the I-1 Zoning District and conforms to the requirements <br /> of the bylaw. The proposed uses are also allowed uses under the bylaw provide the Board <br /> is willing to grant the appropriate Special Permit relief. The criteria that is relative to the <br /> Special Permit relief is set forth in Sections 174-24 C and C2 that the Board shall consider <br /> prior to granting such relief, such as demand on public facilities, impacts on surface and <br /> ground water quality, impacts on estuaries and other waterway systems, impacts on traffic <br /> flow and safety, impacts on endangered species and impacts on neighboring properties <br /> through excessive noise, vibrations, electrical disturbances and glare. <br /> 6 <br />
