*DRAFT MINUTES' BOARD OF SELECTMEN SEPTEMBER 9, 2019 4 Board of Selectmen Minutes September 9, 2019 APPOINTMENTS & HEARINGS De artment of Public Works Director Catherine Laurent: Discussion and Approval of Amendment to Contract for Operation of the Transfer Station-- Shared Use Agreement for Yard Waste Area: The Board of Selectmen awarded a contract with Gotta Do Contracting LLC for the operation of the Transfer Station in fiscal year 2020, and voted to approve the use of a 3-acre site for a yard waste area by Gotta Do for the collections of leaves and brush as well as the retail sale of landscape materials. The Board was agreeable for the shared use of the Transfer Station pending agreeable conditions. A list of(14) conditions was developed with Gotta Do on how this operation would co-exist with the operation of the Transfer Station. The proposed shared use of the yard waste area will generate revenue for the Town without impacting the current services provided to the Transfer Station users. Discussion followed with regards to the operational procedures. It was recommended that a penalty clause be incorporated into the agreement to grant the Town an effective tool for enforcement. The Director of Public Works was supportive of the recommendation to improve oversight. Ideally, an additional shed should be placed at the entrance to the Transfer Station for monitoring purposes. A plate reader is also under consideration for monitoring, but the entrance shed at its location gives little time to scan stickers from the street to the shed. Town Manager Rodney C. Collins recommended that a form of due process be developed in which the operator of the facility would have the opportunity to be heard. With satisfactory approval of the proposal, the contractor is scheduled to begin operations on October 15 2019. With regards to the Town, permit holders would continue to be allowed to drop off yard waste and limited brush. Motion made by Selectman Cotton to approve the Amended Shared Use Agreement with Gotta Do Contracting,LLC for the Yard Waste Area at the Transfer Station authorizing the Town Manager to execute the Amendment with an appropriate penalty clause.
