*DRAFT MINUTES' BOARD OF SELECTMEN SEPTEMBER 9, 2019 4 <br /> Board of Selectmen <br /> Minutes <br /> September 9, 2019 <br /> APPOINTMENTS & HEARINGS <br /> De artment of Public Works Director Catherine Laurent: <br /> Discussion and Approval of Amendment to Contract for Operation of the Transfer Station-- <br /> Shared Use Agreement for Yard Waste Area: <br /> The Board of Selectmen awarded a contract with Gotta Do Contracting LLC for the operation of the <br /> Transfer Station in fiscal year 2020, and voted to approve the use of a 3-acre site for a yard waste area <br /> by Gotta Do for the collections of leaves and brush as well as the retail sale of landscape materials. <br /> The Board was agreeable for the shared use of the Transfer Station pending agreeable conditions. <br /> A list of(14) conditions was developed with Gotta Do on how this operation would co-exist with the <br /> operation of the Transfer Station. The proposed shared use of the yard waste area will generate <br /> revenue for the Town without impacting the current services provided to the Transfer Station users. <br /> Discussion followed with regards to the operational procedures. It was recommended that a penalty <br /> clause be incorporated into the agreement to grant the Town an effective tool for enforcement. The <br /> Director of Public Works was supportive of the recommendation to improve oversight. Ideally, an <br /> additional shed should be placed at the entrance to the Transfer Station for monitoring purposes. A <br /> plate reader is also under consideration for monitoring, but the entrance shed at its location gives little <br /> time to scan stickers from the street to the shed. <br /> Town Manager Rodney C. Collins recommended that a form of due process be developed in which the <br /> operator of the facility would have the opportunity to be heard. <br /> With satisfactory approval of the proposal, the contractor is scheduled to begin operations on October <br /> 15 2019. With regards to the Town, permit holders would continue to be allowed to drop off yard <br /> waste and limited brush. <br /> Motion made by Selectman Cotton to approve the Amended Shared Use Agreement with Gotta <br /> Do Contracting,LLC for the Yard Waste Area at the Transfer Station authorizing the Town <br /> Manager to execute the Amendment with an appropriate penalty clause. <br /> Motion seconded by Selectman Sherman, <br /> VOTE: Unanimous. 4-0. <br /> Roll Call Vote: <br /> Selectman Gottlieb,yes Selectman Cotton, yes Selectman O'Hara, yes <br /> Selectman Sherman,yes opposed, none <br />
