No public comments. PRE/POST-HEARING AGENDA: • Minutes: September 26, 2019 Minutes Motion: Mr. Smith moved to approve the 9/26/19 minutes, Mr. Dalton seconded. Vote: 6-0 unanimous • Update on Enforcement Order: 110 Popponesset Island Road Tabled from last meeting, enforcement order has been drafted. • Update: Lopez Land Swap—Selectmen Endorsement Presented at Town Meeting for Selectmen to review and send to State. They unanimously approved, and sent to the State. Mr. Sweet asked if it's a rubber stamp thing, Agent said he thinks it's going to be discussed in detail because the abutters (MA Fish and Wildlife & Trustees and Reservations) do not agree with the swap and have some concerns. Mr. McKay asked if the agent would be attending any state discussions. The Agent said it's out of our hands. Mr. Sweet said it feels like we lost our voice. The Agent explained we really aren't part of this next step,we've done our part in the process. Mr.Sweet asked if we get the opportunity to tell our side of the story, the Agent said he really isn't sure. HEARINGS: 6:00 Steven D. &Michelle H. Herwald, LLC,2 Summersea Road. Proposed reconstruction of pier, NOI ramp, and float with addition of a platform and mitigation plantings. Continued from 8122 and 9112:detailed mitigation plan required. Michael Borselli from Falmouth Engineering and Emma Vautour from Blue Flax Design represented the applicant and submitted a comprehensive buffer mitigation plan with native planting. The mitigation size and shape is exactly the same as previously approved. They increased the size of the vegetative buffer. Mr. Sweet asked if the owner has reviewed and is comfortable with the plan. Emma said yes. The agent said this shows the detail of what is proposed if the Commission approves the wider platform. The exchange in this case may result in a net benefit of providing a buffer at the top of coastal bank. He agreed the planting list looks
