PLAN REVIEW MEETING MINUTES <br /> AUGUST 5, 2005 <br /> PRESENT: Richard Stevens, Charles Maintanis, Tom Fudala, Ronnie Warden, Catherine <br /> Laurent, Sheldon Hamblin and Pat White. <br /> Also, Benjamin Cartwright, Karen Darrah,Neil Dupont, Argemiro Lopez. <br /> Opened 10:00 a.m. <br /> Projects Under Review: <br /> 26 Christopher Lane <br /> Benjamin Cartwright <br /> Park Tri-Axle Dump Truck on his Property <br /> Mr. Cartwright is seeking permission to park his heavy-duty tri-axle dump truck in his driveway <br /> during his non-working hours. He is constructing a garage with the hope to house his truck there <br /> so neighbors will not see his truck. <br /> Tom Fudala stated that the by-laws do not allow a commercial vehicle over two-ton capacity to <br /> park in a residential area. Anything over two tons must be parked in a commercial/industrial <br /> zone. He cannot get a special permit for change of use from ZBA because the zoning laws will <br /> not permit it. If it does not appear on the current"Use List,"then it is not allowed. This <br /> Committee has no authority to override the zoning. The only alternative would be to go to Town <br /> meeting with an Article to change the zoning laws. The garage does not help his case because it <br /> is a zoning issue. The concerns include nuisance issues and health regulations pertaining to <br /> diesel and noise. He can also find another place to park the truck in an industrial zone. <br /> Action Taken: This Committee has nothing legal to vote upon since it is illegal to park a two-ton <br /> truck in a residential zone under the present zoning By-laws. <br /> Tom Fudala suggested that the Committee formally vote to approve or disapprove projects <br /> before applicants are approved and issued a building permit. He pointed out that the Committee <br /> has 21 days to act once the plan review application is submitted before it is considered final or <br /> the application is automatically approved. The Committee also needs to send their <br /> recommendations to pertinent advisory boards such as ZBA. Tom suggested designing a form <br /> that can be used to reflect the Committee's decisions and recommendations. Tom will e-mail a <br /> Planning Board Certificate of Action to Pat White as a guideline. <br /> The Minutes from July 15, 2005 were moved and approved as presented. <br /> Adjourned. /A <br /> Mary G�lsthorpe, Recording Secretary <br />
