In compliance and understanding the <br /> group dumped their catch and left the area. Before the group exited the water I asked the male <br /> individual, Cheenulka Pocknett, for his permit or tribal ID, he provided me with his name, Cheenulka <br /> Pocknett and#P408S.The two older male individuals were using bull rakes, and all individuals had a <br /> basket attached to their person that were about 1/3 full with quahogs. <br /> Pocknet and Barber Incident occuring on Wednesday, October 23'd,2019. <br /> At 1645 hours on Wednesday October 23`d 2019 1 received a notification from Cory Hendricks,the <br /> Mashpee Wampanoag First Light Oyster grant manager. He informed me that two individuals were <br /> shellfishing inside the licensed area bounds, he asked them to leave but they were uncooperative and <br /> continued to fish. I arrived on location at the end of Punkhorn Point Road Mashpee MA,02649 at 1700 <br /> hours to speak with said individuals. <br /> Upon arrival I discovered two vehicles on location; a black Yukon GMC XL, license plate number: <br /> 5CN659, and a white GMC pickup, license plate number 5TN388. The two individuals were seen actively <br /> shellfishing inside the Tribe's licensed area which is a direct violation of MGL Chapter 130 section 67; see <br /> attached area location. I asked both parties to stop fishing and come to shore to discuss with them why <br /> they were in violation. <br /> Once the two male parties came to shore, one male by the name of Peco Cheyenne Barber was <br /> compliant and understood the violation that was occurring,while the other by the name of Cheenulka <br /> Daniel Pocknett was screaming profanities towards me. <br /> Barber offered all his necessary information without question and dumped his catch within the licensed <br /> area prior to my asking. <br /> Pocknett dumped his catch in a fit outside the licensed grant area; he stated "Who the fuck do you think <br /> you are,you are out of you jurisdiction". I explained to him that I was well within my jurisdiction to <br /> patrol the licensed aquaculture areas within the town of Mashpee. Pocknett then claimed he was fishing <br /> for his people. I then asked whether he had permission from the Tribe's grant manager or anyone from <br /> the Tribal Government Center, because they have authorized tribal members to fish in the area in the <br /> past. Pocknett could not offer any further information to me and demanded a ticket and no further <br /> discussion. I informed him that he will be receiving notice via certified mail. <br /> Kenneth Thompson Commercial Permit Suspension Update:After attending the first adjudicatory <br /> hearing at the Division of Marine Fisheries office in Boston, it was determine by the Division's Director <br /> and Legal Council that Thompson's Shellfish Transaction Card will be revoked indefinitely.This decision <br /> is rare, and the Division felt that the evidence was through enough to proceed with a revocation of his <br /> license without any further action or reexamination of the findings. The town of Mashpee will put this <br /> on record, and Thompson will not be eligible to hold a recreational or commercial permit within the <br /> town in the future. <br /> Management <br /> Shellfish surveys were conducted in Ockway bay, Little River, and Hamblin Pond.These surveys were <br /> conducted for shellfish population assessment and future shellfish seeding area determination.A total <br />
