5 <br /> Board of Selectmen <br /> Minutes <br /> December 16, 2019 <br /> APPOINTMENTS & HEARINGS <br /> Public Hearing: 2020 Annual Alcoholic Beverage and Entertainment License Renewals: <br /> (continued) <br /> It was further revealed that Mashpee Mini Mart, 401 Nathan Ellis Highway, Mashpee received a <br /> Notice of Violation & decision from the ABCC for the sale or delivery of an alcoholic beverage to a <br /> person under(21) years of age on June 14, 2019. The ABCC issued a Suspension of the license for <br /> (1) day. By decision dated July 11, 2018, the ABCC previously ordered a 2-day suspension which <br /> was held in abeyance for a period of(2) years provided no further violations occurred. Based on <br /> the violation,the Licensee violated the conditions of the 2-day Suspension being held in abeyance. <br /> The ABCC in its discretion ordered that a 2-day suspension be served on and after the 1-day <br /> suspension. The Licensee will serve a total of(3) days. In accordance with the ABCC decision, the <br /> Licensee has served the mandated Suspension of License for a total of(3) days. <br /> The Board of Selectmen opened the Hearing to solicit comment. <br /> Shree Kamakya Devi was in attendance with Attorney Edward Gildea to review the violation and <br /> the requirement to suspend the license for (3) days. It was disclosed the Mashpee Mini Mart <br /> complied with the suspension on Monday, December 9, 2019 through December 11, 2019. <br /> Attorney Gildea indicated his client has undertaken two steps to improve the ability to check <br /> identifications. Mashpee Mini Mart has purchased an identification system with advanced scanning <br /> technology to improve upon the monitoring process at a cost of$5,000, and has re-trained his <br /> employees. Mr. Gildea stated that his client has taken steps to improve the situation, and does not <br /> anticipate another violation. <br /> The Board of Selectmen expressed concern with respect to the repeated offense within a two-year <br /> span and that the initial violation was not taken seriously by the licensee. The license was issued in <br /> 2016 with one prior violation which occurred in 2018. If there is an additional violation, the <br /> licensee would lose his respective license. <br /> Town Manager Rodney C. Collins indicated the device invested by the Mashpee Mini Mart to scan <br /> identification is recommended by the ABCC. The Mashpee Mini Mart is taking a positive step in <br /> the right direction to remain in compliance. <br /> Representatives from Best Buy Beverage were not in attendance to discuss the violation which <br /> occurred on June 7, 2019. The Board of Selectmen directed the Town Manager to notify Best Buy <br /> Beverage of the Selectmen's concern, and actions that would be taken if further violations occur. <br />
