Discussion Regarding Amendments to Submitted Zoning Articles for May 2020 <br /> Town Meeting & Vote to Set Public Hearing Date-Mr. Lehrer confirmed that members of the <br /> Board of Selectmen had expressed concern regarding the medium and large scale solar arrays <br /> and their potential for disturbing large forested areas. Mr. Lehrer,the Chair, Mr. Phelan, <br /> Selectman Gottlieb and Selectman Weeden met by phone with Town Counsel regarding the <br /> matter. Mr. Lehrer reported from the meeting that current Zoning,relative to ground mounted <br /> solar, limited their addition to the Industrial District and would provide protections to the Town <br /> that would not be considered an unreasonable regulation. Additionally, it was advised that the <br /> Bylaw could be amended to allow for the small scale ground mounted system for residential <br /> application. Mr. Lehrer modified the Articles accordingly to include updates to the Definitions <br /> and Use Table. Mr. Lehrer suggested withdrawing the Special Provisions Chapter because it <br /> applied to Special.Permits,which would be unnecessary due to the existing Bylaw currently on <br /> the books. Recommended changes were as follows. <br /> -Small scale solar energy systems, not exceeding 15 feet in height,would be built into the <br /> Use Table, in place of having a separate Chapter. <br /> -Minor amendment to remove language and replace it with medium and large scale as <br /> defined in the Zoning Bylaw and allowed only in the Industrial District. <br /> -Inclusion of roof mounted solar in all Districts to memorialize what was already <br /> happening. <br /> Mr. Lehrer confirmed that the amendments had been forwarded to the Board of Selectmen for <br /> consideration. Mr. Phelan and the Chair agreed that the changes reflected the conversation they <br /> had at their meeting. The Chair further noted that it was Town Counsel's opinion that <br /> Mashpee's Bylaw was not overly restrictive. <br /> MOTION: Mr. Phelan made a motion to submit this version of the proposed Amendments <br /> to the Solar Bylaw,to replace what was previously submitted, to the Board of Selectmen. <br /> Mr..Balzarini seconded the motion. All voted unanimously. <br /> Mr. Lehrer inquired about scheduling a Public Hearing and the Chair inquired about doing so <br /> amidst the COVID-19 pandemic. Mr. Lehrer reported that Planning Department efforts would <br /> be business as usual until further notice. As such, a Public Hearing could be held and public <br /> comment would be accepted by phone during the meeting, as the public would not be allowed to <br /> attend. Information regarding public participation would be included in the Hearing Notice. <br /> MOTION: Mr.Balzarini made a motion, under the recommended regulations, to schedule <br /> a Public Hearing for April 15th at 7:10 p.m. Mr. Phelan seconded the motion. All voted <br /> unanimously. <br /> UPDATES FROM TOWN PLANNER <br /> April 1, 2020 Meeting-Mr. Lehrer confirmed that there were no Regulatory items in the que for <br /> the next meeting. There was consensus to meet the third week of April,unless an earlier meeting <br /> was deemed necessary. <br /> 2 <br />
